Germane to the discussion about Gov. Perry's vaccine mandate, it is interesting to see how the Association of American Physicians and Surgeons viewed the feasibility of the "opt-out."

You missed a long, nasty thread today with the Perrywinkles hysterically claiming that his mandate was not really a mandate because it was so easy to opt out. This certainly puts the lie to that.

I’m a supporter of AAPS...however:

1. Describing the “opt-out” as a “bureaucratic nightmare” is hyperbole. I’ve sent for and received the opt out forms twice; they arrived within a week each time. That being said, I agree that the rules have been set up to make it as difficult as possible to opt out. I do not believe that it was the intent of the TX legislature to make it so. The agency responsible seems to have decided on their own to do this.

2. Private Catholic schools in Texas do not accept the conscience exemption. Their policy is in violation of the law, which was changed around March 2009 and as I understand it now encompasses all licensed private school and day care facilities. The Vatican’s “position paper” (not sure what else to call it) on vaccines is that despite the fact that several vaccines were cultured on (or contain) aborted fetal tissue, Catholics are advised to take them anyway.

Yes it is real interesting since it is dated 2005.

The Exec Order was made in 2007 and Tx legislature killed the order 6 wks after that. Perry included specific instructions that it was to be made an easy opt out.

It never went into effect so this article is irrelevant.

Perry is not damaged goods. His fellow Republicans where pretty tough on him last night. BFD! Perry took the heat from Romney and the others and is still standing.

I gave a best estimate on the date because I didn’t see one. So, I presumed it to be 2005. But why quibble about the exact date? Here is an association of healthcare experts expressing considerable concern about the “opt-out” provision in practical terms.

Of course, those who favor Perry’s mandate are quick to point out that there was an “opt-out,” but the AAPS puts the lie to that provision.

You are missing the point. The law NEVER went into effect. The article by these physicians don’t seem to know that the law never went in to effect period. Therefore this is useless.

Friday, February 02, 2007 • Executive Order BY THE GOVERNOR OF THE STATE OF TEXAS Executive Department Austin, Texas February 2, 2007 WHEREAS,immunization from vaccine-preventable diseases such as Human Papillomavirus (HPV) protects individuals who receive the vaccine; and WHEREAS,HPV is the most common sexually transmitted infection-causing cancer in females in the United States; and WHEREAS,the United States Food and Drug Administration estimates there are 9,710 new cases of cervical cancer, many of which are caused by HPV, and 3,700 deaths from cervical cancer each year in the United States; and WHEREAS,the Texas Cancer Registry estimates there were 1,169 new cases and 391 deaths from cervical cancer in Texas in 2006; and WHEREAS,research has shown that the HPV vaccine is highly effective in preventing the infections that are the cause of many of the cervical cancers; and WHEREAS,HPV vaccine is only effective if administered before infection occurs; and WHEREAS,the newly approved HPV vaccine is a great advance in the protection of women’s health; and WHEREAS,the Advisory Committee on Immunization Practices and Centers for Disease Control and Prevention recommend the HPV vaccine for females who are nine years through 26 years of age; NOW THEREFORE, I, RICK PERRY,Governor of Texas, by virtue of the power and authority vested in me by the Constitution and laws of the State of Texas as the Chief Executive Officer, do hereby order the following: Vaccine.The Department of State Health Services shall make the HPV vaccine available through the Texas Vaccines for Children program for eligible young females up to age 18, and the Health and Human Services Commission shall make the vaccine available to Medicaid-eligible young females from age 19 to 21. Rules.The Health and Human Services Executive Commissioner shall adopt rules that mandate the age appropriate vaccination of all female children for HPV prior to admission to the sixth grade. Availability.The Department of State Health Services and the Health and Human Services Commission will move expeditiously to make the vaccine available as soon as possible. Public Information.The Department of State Health Services will implement a public awareness campaign to educate the public of the importance of vaccination, the availability of the vaccine, and the subsequent requirements under the rules that will be adopted.

Parents’ Rights.The Department of State Health Services will, in order to protect the right of parents to be the final authority on their children’s health care, modify the current process in order to allow parents to submit a request for a conscientious objection affidavit form via the Internet while maintaining privacy safeguards under current law.

This executive order supersedes all previous orders on this matter that are in conflict or inconsistent with its terms and this order shall remain in effect and in full force until modified, amended, rescinded, or superseded by me or by a succeeding governor. You realize that none other than Ron Paul is listed among American Physicians and Surgeons foremost members? This wasn’t any kind of setup now, was it? It’s ok with me if you’re a Paul follower, but the source and any biases they may have is always important in these discussions.

WHO got the BILL to pay for the MANDATE = TAX?????

I read NOT one word in this order allowing the consumer to OPT out of paying for the increased premium.... To be all happy feet about mandating insurance companies to PAY for this vaccine is BamBamKennedy deathcare mentality.

You are correct. There is absolutely no need to "opt out" as the law did not go into effect.

If I had a daughter (I only have sons) I would advise her to have the inoculation and explain why. I would not force her to have the inoculation. Perry had the good interest of health when he made the executive order. However, he was wrong and the legislature quickly corrected his error.

I will vote for him if he is the nominee.

Took me a long time to trace down the original article. It was written in 2005. The reason Perry put that (see my bold section regarding the opt out in the post I made earlier with copy/paste of the executive order) was for the very reason the physicians in the article are stating.

I feel terrible for you Perrywinkles. The Governor has more holes than a block of Swiss cheese. Now comes word that Merck made huge donations to the RGA beginning about the time Governor Perry became its head. Somewhere to the tune of $250K.

Of course, RGA just happens to feature prominently as the number one donor on the Governor’s massive list of donors.

The Governor has been recorded as having more vacillations on this matter than RomneyCare.

No, I didn’t miss the point. The Governor tried to get this bad boy passed through Executive Order as a mandate with the alleged “opt-out” and was only stopped a few weeks later by the Texas legislature.

Even the Governor admits today that he should have listened more and had an “opt-in” instead of an “opt-out.”

But you can’t take back history.

They gave to the Republican Governors Association.

So What.

Merck gave $5K to Perry’s 2010 election and it was 3 years AFTER the mandate w/opt out was dropped.

Pretty stupid of them to keep giving to Perry when there was nothing for them to gain? So much for Crony Capitalism.

The Governor doesn’t have more holes than a block of Swiss Cheese - every person running for President has holes but nobody is looking for the holes in the other candidates.

Seems there are many who are afraid of Perry as a President.

They should be - If he becomes the President of US:

DC is going to get a Texas Rock N Roll for the good of this country.

And We the People will get our country back.
