Solyndra Inc.'s chief executive officer and chief financial officer will invoke their 5th Amendment rights and not answer questions during a Friday hearing before a House investigative committee, their attorneys said.
Attorneys for Solyndra Chief Executive Brian Harrison and W.G. "Bill" Stover, the company's chief financial officer, sent letters to the House Energy and Commerce Committee's investigative subcommittee Tuesday saying the two executives would not answer any questions during the hearing.
"I have advised Mr. Harrison that he should decline to answer questions put to him by this subcommittee based on his rights under the Fifth Amendment," Harrison's attorney, Walter F. Brown Jr., said in a letter to Rep. Clifford B. Stearns (R-Fla.), the committee's chairman, and Rep. Diane DeGette (D-Colo.).
"This is not a decision arrived at lightly, but it is a decision dictated by current circumstances," Brown said in the letter.

Contempt of Congress - If Issa has the courage to start doing it. While these people are safe as long as Obama is President, things could change drastically for them in 2013.
It is not meant for them to "roll over one more time" and hide behind to prevent incriminating others in a crime.
The Solyndra executives are between the horns of a dilemma. By taking the 5th, they are implying that their testimony is self-incriminating, meaning that it will be up to Congress to find the incriminating evidence some other way.
They are going to be Obama's Webb Hubbell. They will take the heat to protect Obama.

They’ll have to go after a 2nd or 3rd tier employee to rat out the ones at the top, and/or as I stated previously, grant immunity to one or more of the top employees.
Of course, I also believe he has so many involved in this, that he has already designated some unsuspecting someone to be the Fall GUY.
And as most crooks, while we are looking at all this, he already has another lined up to pilfer.

Any lawyer would have given that advice. The criminal investigation is very preliminary and this would give the prosecutors discovery they aren't entitled to.
Sure looks bad, though.

Then make them personally appear and invoke the 5th.
They could do that, although the prosecutors might not want them to because it could lose them jurors they might want available. It also could backfire by creating sympathy for them. A lot of people still remember McCarthy forcing witnesses to publicly take the Fifth.
I am dead set against all those deals where the government was acting as a venture capital investor. It opens the door to just the kind of abuses we’ve seen at these two companies. If they can’t raise private capital, they probably don’t look like they’ll develop a profitable business and shouldn’t be funded in the first place.
Unfortunately the "they" in this case is the Obama Administration. Congress would have to find a reason to hold hearings and then show more b@lls than they have regarding Obama's questionable past.

Exactly right, but may I make one correction? "Because the BOY" is half black.
That is his TICKET to do any damn thing he wants to, nobody will touch that MULOTTO BOY, and he knows it. NO ONE.
Those that have voted for him deserve anything and everything they are enduring right now, and I hope it is their HELL on earth. Problem is they drug all the rest of us down with them, and leave us to clean up the PIG STYE.
I’m not mad at them. If there was criminal wrongdoing, it’s in their best interests to shut up, lawyer up, and prepare a legal defense — because you know the higher-ups at both Solyndra and the White House are conferring on who’s going to take the fall.
