WSJ: Eric Holder going after Murdoch

U.S. prosecutors have sent News Corp. a letter seeking information about possible payments made by its U.K. tabloid newspapers to British policemen, according to people familiar with the matter.

The letter of request, sent last week, is part of a Justice Department investigation, these people said, into whether the company violated the Foreign Corrupt Practices Act, a U.S. law t

hat prohibits companies from bribing foreign officials. The fact the Justice Department chose to issue a "letter of request" rather than a criminal subpoena suggests the department has opted for a less confrontational approach to the matter, legal experts say.

Several people familiar with the case described the letter as part of ongoing communications between the company and the government about producing documents related to possible violations of U.S. law.

this year, News Corp. retained Mark Mendelsohn, the Justice Department's former head of FCPA enforcement, The Wall Street Journal has previously reported.

During his time at the Justice Department, Mr. Mendelsohn encouraged companies to come clean about suspected FCPA violations in return for more lenient treatment by the government. He allowed many companies to conduct their own internal investigations using outside counsel under Justice Department oversight.

Mr. Mendelsohn didn't respond to request for comment.

You got no jurisdiction over a British company bribing a british cop, and you are gonna screw up the case that is currently heading to the courts. Unless that is your intent, of course.

Holder wants to bring down FoxNews and he will do anything he has to do to be successful. Obama tried to freeze out FoxNews right from the start but Big Media (surprisingly) stood with FoxNews. This is the most disgusting, hyper-partisan Admin ever!

This is certainly not what that law was intended to cover. Here is the DOJ's own guide to the FCPA:

The anti-bribery provisions of the FCPA make it unlawful for a U.S. person, and certain foreign issuers of securities, to make a corrupt payment to a foreign official for the purpose of obtaining or retaining business for or with, or directing business to, any person. Since 1998, they also apply to foreign firms and persons who take any act in furtherance of such a corrupt payment while in the United States.

In other words, the law is intended to prevent American businesses from bribing foreign officials to get business abroad. Paying a cop for a news tip is not what this was intended to cover.

Of course, the actual language of the statute is very broad, which is what Obamaholder is seizing on.

This is a spectacular overreach where this POS administration hopes it can bury Fox News.

He has the same jurisdiction on this matter as he did with Gibson Guitar claiming they were doing something not against U.S. law but Indian law.

So Eric Holder is the law enforcer for other nations laws.

Ours he doesn’t care about . That is clear.

The community organizer and chief has covered all the bases with his appointments. He has consolidated his power and made the congress an empty body. The Czars he has appointed are now his private shadow government doing his bidding. If you thnk this man is just inexperienced and not ready for prime time you are wrong. He has a plan and it is moving along nicely and he adresses the public with the things they want to hear.

This has been standard practice for as long as there have been newspapers. Sort of like tipping a food server. Once again the idiot Marxist regime opens a Pandora’s Box. Other than being a nuisance to Murdock I don’t see this going anywhere.

Particularly since Onada and his gang of angry commies will be under increasing pressure to save their own butts. Plus the coming general election will be providing other challenges.

It most certainly does NOT apply equally to all.

The American legal system has been thoroughly corrupted and the decision to prosecute is always a highly political and discretionary call.

Federal prosecutors decide ALL THE TIME who will face prosecution and who will not, for similar crimes.
