Reuters’ Mark Hosenball today reported http://www.reuters.com/article/2011/10/05/us-cia-killlist-idUSTRE79475C20111005 that: “American militants like Anwar al-Awlaki are placed on a kill or capture list by a secretive panel of senior government officials, which then informs the president of its decisions, according to officials. There is no public record of the operations or decisions of the panel, which is a subset of the White House’s National Security Council, several current and former officials said. Neither is there any law establishing its existence or setting out the rules by which it is supposed to operate.”

If someone like Awlaki had been engaged in active combat, no one would have thought anything of him being shot. The issue here is that he wasn't in active combat. He was encouraging and directing others in active combat. He's still an enemy.

I don't see any reason why an accused in such a case needs to be brought back for trial. However, I don't like the idea of the executive branch being judge, jury and executioner. That's why we have an independent judiciary. Just as we have a separate FISA court for eavesdropping on spies, maybe we should have a separate court to hear cases like this. The executive would have to prove they have the right guy, and he's guilty. Only after approval by a separate court should the drones be sent after him.

When did congress declare “WAR” ? I just missed that. What date?

Sept 18, 2001.

Public Law 107 - 40 - Authorization for Use of Military Force

That the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.

(b) War Powers Resolution Requirements.--
(1) Specific statutory authorization.--Consistent with section 8(a)(1) of the War Powers Resolution, the Congress declares that this section is intended to constitute specific statutory authorization within the meaning of section 5(b) of the War Powers Resolution.

MAGNUM FORCE

As incredible as it seems, there may be a whole sub-organization within the police force-- sort of a death squad like they had in brazil some years back.

01:29:29 Damn.

01:29:31 Yeah, some nights I wake up, wonder where the hell the world's going to. >p> 01:29:38 I want you to take care of yourself, you understand ?

01:29:59 Hi.

01:30:00 Hi.

01:30:01 Gee, what happened to your face ?

01:30:04 Oh, nothing, just a few stitches.

01:30:09 How about if I bring back a few beers ?

01:30:11 Good, I could use a beer right about now.

01:30:14 I've got your keys, so I'll get your mail, too.

01:30:17 All right, baby.

01:30:18 Keep it warm.

01:30:40 ( man ) DO YOU HAVE ANY IDEA How hard it is to prosecute a cop ?

01:31:02 You "heroes" have killed a dozen people this week.

01:31:06 What are you gonna do next week ?

01:31:12 Kill a dozen more.

01:31:14 Is that what you guys are all about-- being heroes ?

01:31:17 All our heroes are dead.

01:31:19 We're the first generation that's learned to fight.

01:31:24 We're simply ridding society of killers that would be caught and sentenced, anyway, if our courts worked properly.

01:31:31 We began with the criminals that the people know, so that our actions would be understood.

01:31:39 It's not just a question of whether or not to use violence.

01:31:45 There simply is no other way, inspector.

01:31:49 You, of all people, should understand that.

01:31:56 Either you're for us, or you're against us.

01:32:05 I'm afraid you've misjudged me.

It's the Constitution. We are now a nation of a man, not of laws. This Free Republic has been ursurped by obama and this extraconstitutional organization, with no name, no written record, no elective officials responsible to the electorate, a totalitarian govenor who now decides who lives and who dies. It is his choice.

“We lost our country when someone decided that the US Constitution doesn’t apply during war.”

You mean like Lincoln did in 1861?

Guess we’ve been lost a long time.

That’s why I’d put Lincoln near the bottom of Presidents. In practice, the seeds planted by Lincoln didn’t all sprout at once.

Did you read that? I propose that you do read that. That is no DECLARATION of war. It doesnt even apply to anything not directly related to 911! You are kidding me? Total annihilation of the constitution in this assassination. IT Is NOT a license to kill under the constitution forever. Doesn’t even apply to this godless internet guru. What a joke. When the law suit is filed under the 1983 civil rights statute by his family— your tax dollars will go to this idiots family— Millions of dollars! Due process for citizens will be upheld in even the lowest court —big time. What was the evidence?

This is what Obammy’s death panels are all about. They intend to murder the Amerians they deem useless eaters (babies, the elderly and handicapped) through the health care death panel and use this death panel to murder those they deem politically incorrect domestic terrorists.

Our amoral elite are downright dangerous with the power of government, devoid from the culture and ideology of the constitution, in their hands. It is going to get worse.

“It’s a situation to be handled by the Constitution”

International flight to avoid prosecution, continued war-like actions against the country from someone whose citizenship is nothing but a sham to begin with. Sounds like a good kill. And constitutional to boot
