Kid may dodge jail in near-fatal East Harlem shopping cart toss

One of the two pre-teen boys charged with dropping a shopping cart over a fourth-story railing in East Harlem -- nearly killing a philanthropist who was shopping for underprivileged kids -- will be sentenced to as little as probation after pleading guilty to felony assault today.

"I held the shopping cart over and I knew people was down there," 12-year-old Jiovianni Rosario said sadly, in admitting his guilt before Family Court Judge Susan Larabee.

"And I knew somebody could have gotten hurt."

Prosecutors say that victim Marion Hedges remains in serious condition from being struck by the cart. Hedge's family agrees with the deal, they said.

Perhaps those little sweethearts should have been dropped off that fourth-story railing.

Never happen, but, ah . . .perchance to dream. No doubt we will be hearing of them again, along the lines of "after a long history of crime, starting when he was a pre-teen, Mr. X was shot today by a police officer."

He should stay in custody until she gets out of the hospital. His punishment should be directly linked to her fate. Then he’ll learn to care about his effects on other people. Especially because of the uncertainty of the length of the sentence. Tell someone they’re going to do 8 months and they’ll settle down to endure the 8 months, and count. Tell them from day to day “Don’t know, can’t tell,” and you’ll make more of an impact.

What an excellent idea!

“The goal is to get him back into the community.”

Where he will continue to elevate his crimes since he knows there are no consequences. I see burglary, rape and murder in their futures while the “family” insists they are good kids.
