Entrepreneur providing in-home service to elderly fights unconstitutional regulations

PHOENIX — A cancer survivor and former hospice nurse’s assistant is suing the Arizona Board of Cosmetology over rules she says unconstitutionally deny her the right to earn an honest living – while at the same time needlessly denying services to homebound, elderly and bedridden individuals across the state.

Lauren Boice opened Angels on Earth Home Beauty, which connects the elderly, sick, and terminally ill with licensed cosmetologists. Homebound individuals desiring a haircut, manicure, or massage call Lauren, who matches them with a cosmetologist who will visit the client’s home or assisted living center.

But while Lauren’s clients see her as a blessing, the board has made her its latest target.

Even though she neither practices cosmetology nor runs a cosmetology business, the board is compelling Lauren to obey a host of cosmetology regulations. Their edict: Open a physical salon even though Boice will never use it, or close her business for good.

Pharmacies have had to do this since the 80's. A mailorder type pharmacy which specializes in catheters, diabetes drugs, etc,,, has to have a retail storefront location. It is never meant to sell anything. It has to be open for business hours. But it will never intend to sell anything.

Go figger?

The most malignant harm being done by obama is not his public fights with Congress but his ongoing and unhindered behind-the-scenes corruption of the bureaucracy into a leviathan that acts on a national scale, with federal power, like these pricks in Arizona on a statewide scale..

See for example the current NTSB edict attempting arbitrarily to outlaw use of cell phones by drivers of autos. Unelected, unaccountable, no constitutional mandate or enumerated power, but just go ahead and do it. Dittoes the EPA and a host of others.

The bureaucracy being installed by this regime will turn out to be the greatest enemy of the American people we have ever faced.

That’s actually being done...
There’s an address with 1000’s of businesses in it.
I can’t find the story, but there was a small house that hundreds of businesses were using as their address, and the woman who lived there was making a bundle off of it.

It sounds like she's just a 'middle man' and connects clients with service providers.

I see no earthly justification that she needs to open a physical salon. Good for her in fighting this regulation.

reinenting government - it didn’t happen under Al Gore or Newt and yet people think there is nothing but good stuff from our side of the aisle. How long have republicans held a majority in AZ? How about the congress ro ohters states? Nobody stops the unchecked growth of regulations - things that are designed to keep people out of business not to help them get into business. The invisiable hand with destroy the incompetent. Get government out of all the lsicense crap, pare it down to true safety regulations.

And there's no reason for nail-cutters or hair-cutters to be required to go through expensive training and get a state license. I've had plenty of bad haircuts from duly-credentialed hair "stylists" (with their little diplomas hanging next to the mirror).

Now, those who do go through the training, could use it as a selling point. In the end, though, I doubt it would matter to customers.

Reminds me, back in the sixties, my Mom's best friend was a hair stylist. She used to cut our hair real cheap as a favor to Mom. When it was the boys' turn, she drew the curtains and we were pledged to silence because she didn't have a New York State license to cut men's hair and couldn't afford trouble with Albany.

I think the state's "streamlined" things now. One license is good for both sexes (genders?), but I'm sure they doubled the fee. Asinine.

It's about growing government. That applies to both parties. The monster needs to be so big that one side makes money from it's size and scope and the other side makes money from keeping you off it's menu at feeding time.

Either way, big government pays.

too right. The Bush admin would send up a budget and Danny Hastert, Tom Delay and others would increase it 15% or more. So to ask for moderates is a stupid concept - we need government not tax cutters. If someone would start saying I want the size of the gov to be equal to 2006 that would be a start.
