Man charged in attack on Simmons site

LOS ANGELES - December 13, 2011 (WPVI) -- A Connecticut man affiliated with a hacking group was arrested Tuesday on federal charges for an attack on a website belonging to Kiss bassist Gene Simmons, authorities said.
Kevin Poe was indicted in Los Angeles on two counts: conspiracy and unauthorized impairment of a protected computer. Poe made his initial appearance in court in Hartford, Conn., and was released on $10,000 bond.
If convicted of both charges, the Manchester man faces up to 15 years in prison. An email message left for deputy federal public defender Deirdre Murray was not immediately returned.
Poe and others linked to the Anonymous hacking group conducted a "denial of service" attack over a five-day period last October against Simmons' computer systems, sending tens of thousands of electronic requests designed to overload the server and render www.GeneSimmons.com useless.

15 years for effectively just accessing the website (abet, the theory being, doing it thousands of times a minute in concert with others to overload the site...) and a supposed conspiracy to do this with others, though it appears his fellow defendants are...John Does.

I kind of agree. This would be like putting people in prison for being part of a flash mob. You know where people pile into a store for a few minutes...I’m sure they lose customers when that happens.
But I guess they’d have to be a flash mob for 5 days or more...like the OWS bozos. hey wait maybe this is a good thing...let’s use this law to throw them in jail for 15 years.

A DoS attack is NOT "accessing" a site. It uses a specific type of tcp packet that is in no way similar to just a bunch of people overloading a server. In many ways, it's a "counterfeit" packet, designed for malicious purposes.

Not to give the wrong impression, I can quite understand jail time for this, but significant jail time seems excessive. Significant financial penalties and a short sentence seems reasonable for such cyber thugs, OWS thugs, and other thugs as well. But putting on a more significant sentence than if someone went up and punched Gene Simmons seems out of line here, and yet another sign that so much of the justice system needs to be fixed.
Oh, I think about 20 minutes with selected members of the FreeRepublic userbase ought to be more than enough. Save the whole hassle of booking and the rest... I think my objection solely revolves around the target (some business website) without any risk of danger to life and limb (IE: it's not medical records, power company, etc.) How could the penalty for denying use of that business for 1 day 4 hours result in a fifteen year penalty?
I have always though that someone that puts a virus on your computuer is committing vandalism. Each computer effected in another act of vandalism...also no different than breaking into your house and smashing your 40 inch plasma tv with a baseball bat. You have a malicious breaking and entering, vandalism, denial of the victims right to access public information, with a business, its money lost, and who knows what else. It should be treated as a major crime, not just 15 year old playing with his computer to see what he can do...People that do this are criminals...
