Tea Party Patriots co-founder Mark Meckler was arrested at an airport in New York City on Thursday after he attempted to check-in a locked gun box holding his Glock 27 pistol and ammunition to a Delta Air Lines ticket agent.
According to authorities and his attorney, Meckler, 49, holds a concealed-carry permit for the Glock 27 pistol at home in California, but not in New York where he was attempting to board the plane. As a result, he was arrested and charged with a felony.
“Before leaving home, passengers should acquaint themselves with the weapon laws of the jurisdiction that they are visiting and comply with any and all legal requirements if they choose to travel with a weapon,” Queens District Attorney Richard A. Brown said.
“Otherwise, they may find themselves being arrested and charged with a felony – as is what occurred in this case,” he said.
Attorney Brian Stapleton of Goldberg, Segalla, LLP said Meckler was only attempting to follow TSA rules for checking in a firearm when he was arrested.
“While in temporary transit through the state of New York in possession of an unloaded, lawful firearm that was locked in a TSA-approved safe, he legally declared his possession of the firearm in his checked baggage at the ticket counter as required by law and in a manner approved by TSA and the airline, yet was arrested by port authority for said possession,” Stapleton said.
Meckler was arraigned Thursday in Queens Criminal Court and charged with second degree criminal possession of a weapon, a Class C felony.
Meckler was released Thursday. He has a court date set for Jan. 12, 2012.
Brown said Meckler, a well-known person in the tea party movement, told authorities he keeps the pistol with him because he gets threats.

* Travelers must declare all firearms to the airline during the ticket counter check-in process.
* The firearm must be unloaded.
* The firearm must be in a hard-sided container.
* The container must be locked. A locked container is defined as one that completely secures the firearm from being accessed. Locked cases that can be pulled open with little effort cannot be brought aboard the aircraft.
* If firearms are not properly declared or packaged, TSA will provide the bag to law enforcement for resolution with the airline. If the issue is resolved, law enforcement will release the bag to TSA so screening may be completed. TSA must resolve all alarms of checked luggage. If a locked container containing a firearm alarms, TSA will contact the airline, who will make a reasonable attempt to contact the owner and advise the passenger to go to the screening location. If contact is not made, the container will not be placed on the aircraft.
* If a locked container alarms during screening and is not marked as containing a declared firearm, TSA will cut the lock in order to resolve the alarm.
* Travelers should remain in the area designated by the aircraft operator or TSA representative to take the key back after the container is cleared for transportation. Travelers must securely pack any ammunition in fiber (such as cardboard), wood or metal boxes or other packaging specifically designed to carry small amounts of ammunition. Firearm magazines and ammunition clips must be securely boxed or included within a hard-sided case containing an unloaded firearm.
* Small arms ammunition, including ammunition not exceeding .75 caliber for a rifle or pistol and shotgun shells of any gauge, may be carried in the same hard-sided case as the firearm, as long as it follows the packing guidelines described above.
TSA prohibits black powder or percussion caps used with black-powder.

NJ/NY are “Iron Curtain” States in terms of gun control. People on FR from Penn have told horror stories about being in “technical violation” of the law by crossing the border to visit someone and having certain type weapons in their cars.

True, the Federal law makes it impossible for you to be convicted of a felony, but NYS is free (under the letter of the law) to make you suffer as much as possible PRIOR to your inevitable acquittal.

A very bad law. The American public became instantly outgunned by every agency of government that you care to think about, and every day that passes, we become more so.
The 1968 law is just as bad and both need to find their way to the ash heap of history along with I might add, all living individuals who so thoughtlessly, but with malice aforethought brought these two anti-constitutional pieces of crap into being.
For you NRA lovers, Charleton Heston was a prime mover at the time Congress was attempting to enact the 1968 law. Some consider his backing of the bill to have been an essential element in it’s passing. I forgive him, but how can one forgive the NRA? Their complete lack of leadership was just as bad if not worse.
The question is why did he have the gun - if it was in his baggage, he was technically breaking NYC law as soon as he pulled it off the carousel. If he was just making a connection, it shouldn't have left the tarmac.
Don't check firearms to locations that prohibit firearms possession.
Even better, don't even visit those locations.

If he stayed over night in NY with his glock, then tried to leave another day...HE’S VERY VERY SCREWED.

Why would it be Delta’s fault? You have to declare a checked firearm nomatter what airline you fly.

When I was in Chicago the Delta agent called the Police to investigate me. I’ve flown on Alaska Air out of Chicago without such treatment.
