9th Circuit panel rejects suit filed by 'birthers' against Obama

A group of Southern Californians who insist that President Obama was born in Africa and should be ousted from the Oval Office had their case thrown out by a federal appeals court Thursday, but vowed to press their conspiracy theory with judges at the top of the judicial chain.

None of the "birthers" who filed suit on Inauguration Day 2009 can show that they suffered any harm from the Obama presidency that would give them the right to sue him, a three-judge panel of the U.S. 9th Circuit Court of Appeals said in dismissing the lawsuit brought by dozens of opponents.

Even the political candidates who lost to Obama in 2008 would only have had standing to sue if they had filed their complaint alleging unfair competition from an ineligible candidate before the election, the 9th Circuit judges said.

Lawyers for dueling factions of birthers said they would appeal the decision, with one group planning to seek review by a full 11-judge panel of the 9th Circuit and another that will go directly to the U.S. Supreme Court with a petition to reverse Thursday's decision.

the plaintiffs couldn't show they had been harmed

My understanding of the courts is that the 9th Circuit is the most liberal of them all. Why did they bring this action in the 9th? What am I missing here?

The 9th Circuit Court of Appeals has been overturned by 50%.

Why did they go that route instead of the 11 Circuit Court where even a Clinton Appointee voted to over turn Obama Care.

Ahh! The overused, abused ‘legal standing’ issue once again rears its ugly, judicial-activist head.
The fine legal minds here on FR have explained this over and over, and still it makes no logical sense to any rational human being, especially in this instance.

This bozo needs to vacate the office to which he pretends; and, soon.

This country seems to love to have another four years of this progressive socialism because the MSM told us so. Heck, they have even selected a backup liberal to run the country if Obama fails to hold office in 2012 and that man is Romney.

It does not matter what party the “replacement” is from, it’s the same old liberal “bait and switch” crap that has been fed to us by both parties and nothing is going to change other than even more loss of freedom and control of our government.

Romney = Obama. Obama = Romney. Republican = Democrat. Democrat = Republican. Who the hell can tell the difference?

Articles like this in the LA Times I can’t even get through. The bias so easily seen in how they pick and choose which points to bring up, and especially in their choice of wording — completely supporting the courts decision, and deriding the plaintiffs and their case as nothing but a conspiracy theory...

It’s one thing to report the findings, it’s another to write an article as if one’s classmate just got in trouble with the principal and you’re standing in the middle of the playground gossiping, and making fun... I guess some people never grow up (without looking I’m going to guess it may be a female writer because it definitely sounds like it was written in a “mean girl” style).

This is a total political hack job and NOT a “news article” by any stretch of the imagination... This type of “journalism” literally makes me ill.

LOL - I guess I was right about it being a woman who wrote this... “Carol J. Williams”. Tried looking up a bio, but no luck as of yet. I just get this feeling from her writing that she’s not someone you’d really want to be friends with - just gives off that “mean girl” vibe I guess (she’s probably known as a “really nice person” among her liberal cohorts).

I don’t get the harm thing. What does someone breaking the law and not harming me have to do with anything. People who drive without licenses don’t harm me personally but they do break the law and do get fined for breaking the law every day.

Perhaps this was a strategic decision to get it the Supreme Court to a particular Justice...

Okay, we are now in a period of time before the election - the 2012 election. Somebody needs to re-file and use the 9th Circuit's dictum against them.

Heck, get somebody that's 21 years old to try to get on a ballot to run for President. Knowing that the constitution requires a president to be at least 35 years old, he/she will be challenged. Once the precedent is set that you have to prove you are 35, it could be used to have to prove you are a natural born citizen.
