Pepsi Beverages pays $3.1 million to settle federal race discrimination charges

WASHINGTON — Pepsi Beverages Co. will pay $3.1 million to settle federal charges of race discrimination for using criminal background checks to screen out job applicants — even if they weren’t convicted of a crime.

The settlement announced Wednesday with the Equal Employment Opportunity Commission is part of a national government crackdown on hiring policies that can hurt blacks and Hispanics.

EEOC officials said the company’s policy of not hiring workers with arrest records disproportionately excluded more than 300 black applicants. The policy barred applicants who had been arrested, but not convicted of a crime, and denied employment to others who were convicted of minor offenses.

Now just WHY are Criminal Background Checks somehow discriminating against Blacks and Hispanics?

I guess in the same way that Voter ID is "dis-enfranchising" Minorities.....

Discriminating against criminals affects criminals disproportionately.

Who could have predicted!

Why wouldn’t any self-respecting company fall over itself to hire thieves, etc.?

I guess I just don’t understand business...

Let’s see now. It’s wrong to do criminal background checks. It’s wrong to require a high school diploma. It’s wrong to ask for identification. It’s wrong to require drug testing for welfare recipients.

As usual much is not told, such as if a formal acquittal or propmt dropping of all charges served to nullify Pepsico’s concern about an arrest. Gun owners should especially be aware of crimes-on-paper.

Pepsico not too long ago, and maybe still now, had a process in which they used aborted fetal kidney cells to somehow evaluate the flavorings in their soft drinks. How that is supposed to beat out the old fashioned taste test, I do not know.

One may surmise from the basis of the EEOC's lawsuit that they automatically assume that all blacks and hispanics must have criminal records becase they are black or hispanic.

I say we sue the EEOC for racist practices.

I happen to work at a prison (since the early 80’s); I am all for giving people a second chance, in a controlled situation.

But, should we force employers to do so? Hell, no!

The use of arrest records is stupid. Other than that it really should be none of the governments business.

The ironic thing is that it is the government who produces these records in the first place. They sell the data which is then aggregated by private companies. Any such private company who sells arrest data for pre-employment screening is foolish. Conviction data is another matter entirely.
