California Bans Open Carry Guns.. Now Ban on Rifles Too?

Its called the open carry law, and its now the law in California - when it comes to handguns.

Governor Jerry Brown signed the bill into law that bans 'unloaded handguns in public.' It went on the books on earlier this month. (January 1st.)

With the new law, California residents can no longer carry an unloaded handgun in public.

Now, Democratic Assemblyman Anthony Portantino wants to expand that ban to rifles.

Portantino says he wants another law because some California residents are now showing up in public with unloaded shotguns and rifles.

So, he wants another law...

This is a slam dunk case for the Supreme Court.

True, but the penalty imposed by the House (see my post #33) would be absolutely devastating politically -- and Pres. Obama would be obliged to fight it, it would put him and his friends' gun-grabbing, anti-freedom agenda squarely on Center Stage in an election year. It would force every 'Rat in the country to defend an issue on which they are hugely out-of-step with the country.

If he didn't mind his P's and Q's, Obama could end up being impeached -- in an election year -- forcing his Senate allies to defend him, in the midst of his Gunwalker scandal and California's epic constitutional punishment and a national election campaign. No telling how many Senate Democrats would lose their seats in such a shellacking.

And they might just roll over and convict him, removing him from office so they could put up Hillary to defend the Party instead of the Chicago Boys (small irony: she's from Chicagoland, too).

Boehner could lose his Speakership, trying to slam the brakes on the entire conservative wing of the Party, when the Main Enemy and a huge potential prize is clearly in view. He'd have to lead, follow, or get out of the way.

Yes, well, the 2nd is bound to California, so if they try to deny the right to their citizens, then the 14th provides a powerful corrective.

Oh, and as long as they didn't change their laws abrogating the right ..... their House delegation would be locked out, depriving the 'Rats of dozens of CaliforniaRats' votes.

What does your post have to do with what I posted? My point was that the line has been crossed and any Californian that isn’t currently loading up their magazines, packing their gear, sharpening their pitchforks, and lighting their torches should just accept the fact that they are now serfs. No longer free. They have completely abandoned their liberties and refuse to protect their Rights.

Period.

Full stop.

9th Circuit remedy? Voting your legislators out?

Why doesn’t California make it official and ban breathing? They’ve been a bloody testcase for just about every breed of insanity known to man, so quite beating around the bush and just openly say it, screwballs.

I really wish for a serious disaster in CA. It is the only way their government is going to be destroyed and the people are going to get their freedom back. CA is going to keep going until it is a threat to the United States.

What part of “shall not be infringed” does the State of California not understand? (The State of California is very clever, it asserts repeatedly that it knows various substances cause cancer, so I assume it can read the U.S. Constitution.)

I still take the position that the several states may regulate the bearing of arms in manners analogous to what the Founders would have recognized as elements of a militia manual of arms: if they want to require that members of the unorganized militia bear arms openly, they are welcomed to ban concealed carry, so long as open carry is unfettered; if they wish members of the unorganized militia to be discrete about the fact they are armed, they are welcomed to ban open carry, so long as concealed carry is unfettered. Either of those policies, or ones in between with unfettered open carry and various permitting regimes for concealed carry, do not infringe the right to keep and bear arms. California’s laws plainly do, and I trust there will be challenges, given recent 2nd Amendment jurisprudence.

Whaddya mean “finally”? They got us outnumbered by enough to ram down just about any POS legislation that falls outta their anal orifices.

Those of us that’re still here slogging away are doing it to keep the bastards distracted long enough for the women, children ,and elderly to GTF outta here.

Meanwhile, we’re exploiting the system to do things like take advantage of the most educational liberty known in any of the 50 States to raise our kids our way — OUTSIDE the walls of the State-run schools. Wherever we can, we’re using the Commie-lib’s rules against them; forcing them to eat he crap they dish out. This is socio-political guerrilla warfare out here; it ain’t pretty, and it makes no sense at all on the surface, but we force the cost of every one of their victories to exceed the price of our concessions, even if that isn’t readily apparent.

When the last of us steps backward across the state line, I promise, we’ll bring out the flag, and shut out the lights. The Commie-libtards can take what’s left, and play “Lord of the Flies” until the whole thing implodes; probably in the throes of a violent uprising of their below-minimum-wage illegal alien service workers. I can only hope that the rest of the country has the good sense to start saying — and KEEP saying — “HELL NO!” to every Californian request for Federal money.

What does a piece of paper matter when no one bothers to enforce it? If there are ZERO consequences, then it isn't much of a deterrent now is it?

It matches up perfectly with "the Right of the People to keep and bear arms shall not be infringed."

Period. Full stop. Anyone trying to tell you otherwise does not have your best interest at heart and is violating your Rights. Doesn't matter if they are an elected official, a law enforcement officer, or another private individual. If they try to forcibly disarm you for your peaceful exercise of your Rights, they are no better than any other street thug and should be treated as such.

And before you think the Courts will help you, maybe you have forgotten that the 9th Circus is your first hurdle. Unless you have millions of dollars, you will not find justice there.

I’ll believe it when I see it.

California was past the tipping point when they after SKS rifles ten years ago or so.

People will put up with anything as long as it doesn’t impact their comfort zone.

We’ll see how many Patriots stand up; who’s willing to get arrested and make a public example in court?

How’s this: Try to organize get ONE THOUSANDS gunnies together in the street, all OPEN CARRYING. Challenge the law, and let’s see if they try to arrest a thousand people.

Make sure there are plenty of cameras rolling, so the mediots can’t cover it up.

Good luck. You’ll be lucky if you get twenty to show up.

With Boehner???? Are you kidding? They can’t even bring themselves to stand up and turn their backs on this fraud potus. You really expect them to do something that requires testicular fortitude?

How about trying to get the NRA to help organize a thousand-man gathering? Again, Good luck.

If we had people in government that actually CARED what the Constitution says, we wouldn’t be having this discussion.

They wouldn't go after 1000. But neither would they remove the law from the books. They'd let you have your little protest, then go back to business as usual.

Make it an ARMED protest and march on Sacremento. THAT will get their attention.
