Appeals court rules in legal fight over dead dog

RALEIGH The N.C. Court of Appeals has waded into a legal tussle over the wrongful death of a Jack Russell terrier.
Nancy and Herb Shera of Wilmington sued North Carolina State Universitys College of Veterinary Medicine in 2009, seeking more than $28,000 in damages after their dog, Laci, died following a botched tube feeding.
In a 20-page ruling issued Tuesday, the appeals court unanimously upheld an earlier ruling by the N.C. Industrial Commission, which decides compensation claims involving state agencies. The state commissioner had awarded the Sheras $2,755 for vet bills plus $350, the estimated cost for a new dog of the same breed.
Laci had her own unique, distinct personality, Nancy Shera said. She brought so much joy to our lives. She was a part of our family. You cannot replace Laci.
The Sheras bought Laci as a puppy in 1994 for $100. The couple, who has two grown children, quickly formed a strong bond with the dog.

Cripes, the dog was 13 years old when she died. Sad to lose a pet when they seem like part of the family but people have to be realistic.
They got the dog in '94. The dog was 13 when it died...and had all kinds of problems....for years.
Mom was taking the dog to a Vet school...and I'm not sure why not a reg vet.
She sure put the dog through hell...for years. Sorry...pretty cruel in my mind.
My dog “shorty” a jack Russel, is one of a kind.
A personality all his own. I can’t say yea or nay
about these folks but I sure would miss him.
The dog was obviously dying when she brought it to the VET SCHOOL the last time. Bet they know someone at the school & the attorney is a personal friend also. He knows he's not going to get paid.
Due to a paperwork oversight by the original owner and failure of the city to check microchip contact info, a 7-yr old runaway golden Lab in ABQ was adopted out to a new owner who now will not return her to the original owner who had her since she was a puppy. The new owner says “no way in hell” will she return the dog.

I know it’s a petty point but there are yellow labs and golden retrievers (unless it’s a mix of the two). Sorry. This one is a yellow lab. My goldens insist I correct this whenever I see it. ;)
NC State is the referral many vets make for additional testing such as MRIs, and uncommon surgeries or treatments that require special equipment or skills.
One of the top vets in the US who treats Syringmyelia in CKCS is there.

You are so correct - a yellow lab. I should know better; I had a combo black lab-golden retreiver mix for fourteen years! A fence jumper got into the back yard of the pure bread golden and I took one of the litter - a very healthy hybrid, black in color with one white star on his chest. He loved everyone, carried everything in his soft mouth, but his tail would knock over small children. And his loud, full throated bark kept away door-to-door solicitors.
13 isn’t all that old for a JRT. She might even have some 5 years in her.
Now, if that was my German Shepherd - well, it wouldn’t be!
“I know its a petty point but there are yellow labs and golden retrievers”
LOL not petty to me! 1 of those “petty” things that drives me nuts. Didn’t we just have an article the last few days that said “golden labrador”? I held my tongue.
My only thought is it could be a Golden-Labrador mix. But I know alot of people have no clue; they think a yellow is a “Golden”.

Regular vets refer tough cases to Vet schools all the time. That one (NC State) is one of the finest veterinary treatment centers in the country.
My dog was saved by the specialists at VA Tech. They’ve got resources a vet in private practice could never afford.
Awww. They have common ancestry, so they probably make a decent mix. I prefer the golden, in general not as stubborn and easier to train, however they can be softer so that has it’s own set of problems, especially in a working dog, but it just depends (and the coat of course can be an issue). Fourteen years, nice. My oldest golden has only lasted 13, I hope my current 2 will give me a few more than that. Both are middle aged now.
Made me laugh about the tail. My other breed is dock tailed and I will say, sometimes that’s really nice, they don’t clear the coffee table of everything when they get excited! :)
I knew because I had read the article (and I knew Dave was nice and wouldn’t get offended!)
“Says they had attorney fees of more than the $28,000 they were asking for. I would say they’re not too bright..”
I don’t think their atty is too smart either.
{SIGH}
These stories always remind me of a woman I worked with, who was very bitter when her elderly uncle (or somesuch) died in his nursing home.
The man was very old, he had to have been in his 80s at least.
And she basically said to me: he was so old and sick and then he got so bad, so fast, why wasn’t something done?
Circle of life folks, I know it is hard, but we’ve all got to deal with it.
