Judge grants temporarily injunction barring enforcement of voter ID law in April election [WI]

A Dane County Judge on Tuesday granted a temporary injunction that bars the enforcement of the state photo ID law at polling places during the general election on April 3.

Circuit Judge David Flanagan said that the Milwaukee Branch of the NAACP and Voces de la Frontera had demonstrated that their lawsuit against Gov. Scott Walker and the state Government Accountability Board would probably succeed on its merits and had demonstrated the likelihood of irreparable harm if the photo ID law is allowed to stand.

Flanagan ordered Walker and the GAB to "cease immediately any effort to enforce or implement the photo identification requirements" of the law, pending a trial on a permanent injunction scheduled before him on April 16.

"If no injunction is issued, a clearly improper impairment of a most vital element of our society will occur," Flanagan wrote. "The duty of the court is clear. The case has been made. Irreparable harm is likely to occur in the absence of an injunction."

Thanks for the clarifications. I’m not in Wisconsin, so I don’t have details. I do know, however, how pugnaciously-principled (a new goal for the GOP!) Walker and the Republican legislature have appeared to be from this distance, so it seems certain they will appeal this buffoon’s ruling to what seems to be a sympathetic state Supreme Court.

There should be plenty of time to appeal the injunction prior to the April elections. SCOWISC will strike this down by a one-vote margin, with a couple of chokeholds to boot.

But will it get heard by the SCOWISC prior to the April 3 general election? It just seems that this needs to be expedited & brought before SCOWISC in a big time hurry.

Is this the date of the recall election for Walker & the other 4 GOP legislators being recalled?

I like Walker's steadiness under pressure, but it seems that the RATs are constantly filing these lawsuits in Dane County and I don't know why the GOP & Walker are not fighting back with both barrels. In fact I believe a Waukesha county district judge had ruled that multiple petition signatures & Mickey Mouse signatures could not be used.... and yet a different Dane County judge ruled against Walker having more time to scroll through & challenge these bogus signatures.

I hate the RATs & unions & liberal judges with a passion...but it seems that for every lone or solitary battle that we win, the RATs & libs & unions win a sh-tload of battles.

Unbelieveable!

No, the only elections taking place on 4/3 are the presidential primary and a bunch of judicial seats (including Flanagan’s, but since he’s in Madistan, he’s running unopposed — they like ‘em crazy there).

Plus, Flanagan’s wife circulated the petition he signed (it wouldn’t surprise me too much if he claimed she affixed his signature fraudulently), and his campaign manager is a long-time aide to Kathleen Falk, who is running against Walker in the recall election!

The clown may now hold the American record for sheer number of conflicting interests.

Thanks for your reply! Whew! I can only hope & pray that Walker & the WI GOP are able to get this issue greenlighted & expedited to the SCOWISC to squash this injunction. I believe that Flanagan is the libturd judge who is supposed to rule on this in a formal court hearing April 16. Wow, I wonder how he will rule on his own injunction? sarc/

What a RAT bastard Flanagan and the entire demoRATs, unions & judicial system are... they all deserve to go to the gallows!

The premise is that the person involved registered when they were younger and were driving, but that they have now aged to the point that they can no longer drive and have not maintained a valid Driver’s License.

Oooo. So I can’t be required to show a government-issued ID to exercise my Constitutional rights? I guess that ID requirements to buy and carry guns just went out the window in Wisconsin, eh?
