The Vetting: Obama's Supreme Court and Critical Race Theory
Big Government ^ | March 9, 2012 | JOHN SEXTON

Posted on 03/09/2012 3:12:54 PM PST by opentalk

...Fortunately, we have another description of Critical Race Theory from an unimpeachable source: Supreme Court Justice Elena Kagan.

In 1993, Kagan was asked to present a lecture on CRT. Her notes for that class, dated October 25, 1993, became part of the record during her confirmation hearings in 2010--but the Senate failed to press her on her support for a theory that, by her own admission, was race-obsessed and radical.

.... What most critical race theorists believe is that law, in a variety of ways, works to maintain the subordination of members of minority groups. And what most critical race theorists believe is that the achievement of racial justice in this country, if possible at all, will require not merely the more even-handed application of current laws --that will do less than nothing -but a root and branch transformation of the legal system.

...The issue came up in legal circles during debate over the nomination of Justice Sonya Sotomayor, particularly with regard to her comments that a "wise Latina" might reach a "better conclusion" than a white male, and her ruling (later overruled) against white firefighters alleging discrimination in the Ricci case.

Regardless, Critical Race Theory is emerging as an important theme among some of President Obama's most important influences--and most important appointments.

Judge Richard Posner, U.S Seventh Circuit Court of Appeals, on Critical Race Theory:

"What is most arresting about critical race theory is that...it turns its back on the Western tradition of rational inquiry, forswearing analysis for narrative. Rather than marshal logical arguments and empirical data, critical race theorists tell stories — fictional, science-fictional, quasi-fictional, autobiographical, anecdotal — designed to expose the pervasive and debilitating racism of America today. By repudiating reasoned argumentation, the storytellers reinforce stereotypes about the intellectual capacities of nonwhites"

Thanks to freeper Pan_Yans Wife for Kagan/Bell article !

Kagan...In 1985 helped Bell get his radical writings about blame whitey published at Harvard Law

Why Elena Kagan is no Tina Brown

......As articles editor for the Harvard Law Review in 1985 Kagan helped shepherd into print a racially noxious story by a radical law professor and architect of Critical Race Studies, which is essentially "blame whitey" in legal vernacular.

...This was no literary fiction. It was the kind of story that would never get past Tina Brown at the New Yorker. What Derrick Bell, the author, was doing, observes legal scholar Arthur Austin, was "making broadside comments on the tyranny of white people." Austin, in an article, ranked Bell's fable one of the top 10 politically correct law review articles s of all time.

Bell's fiction was a way to circumvent law review standards.

I never heard of this before Breitbarts video. Seems to disregard --everyone is equal under the law, justice is blind. Instead rule of law, it depends who you are and color of your skin (reverse racism?).

Interesting, consequences of breaking the law, are harsher in many instances for US Citizens compared to illegal immigrants.

Sounds to me like more of the tired ugly side of the civil rights movement—more interested in wreaking some sort of revenge for past social wrongs...than seeing to it their children have a just future.

More of the Malcom-X, Louis Farrakan, Jeremiah Wright bad-apples...of the way rejected by Dr. M. L. King.

To me these bitter attitudes-put-into action, illustrate the importance of faith in a loving and just God—one who will set perfectly right all past wrongs, at the last judgement—giving everyone a fresh start, every day, if only they will listen...

Some of the Nazi hunters seem to approach the same sort of attitude (albeit for much more serious wrongs...), seeming to assume if they don’t get some court to condemn these old guys now, they will have escaped justice. Wrong...

Exquisite justice is on its way.

Other things are starting to make sense, Sotomayor's odd ruling against the white fire fighters (overturned) and Kagan -was not a Judge before nomination to Supreme Court. More of an activist.

These are life appointments. Wonder if Obama eligibility issues would impact that.

at first I was discouraged by the lack of ooomph to the video, but now I’m starting to have hope.
could be the groundwork for connecting the dots between a large number of appointees and czars.

Add this racial business to the known marxists - and remind America that we used to fight communists - not elect them to office.

According to the article is sounds like it was discussed

Sotomayor and Race

Given the years of virulent racism that minorities in our country have faced throughout our history, it is a bit shocking to see right wingers like Newt Gingrich and Rush Limbaugh accuse Supreme Court nominee Sonia Sotomayor, the first Hispanic ever nominated to that Court, of being a “racist,” based solely on one remark that she made in a speech seven years ago.

“I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.” Why would Sotomayor say such a thing? It is clear from reading her speech that Sotomayor was asked to comment on how her experience as a Latina woman colors her perception of issues on the bench. This subject is understandable given the Critical Race Theory roots of the La Raza publication that hosted Sotomayor...

... it is clear from her speech that she is responding to this CRT critique of the law. In her speech, Sotomayor describes her personal experiences as a “NewYorkrican” and acknowledges that these experiences have an effect on how she sees the world.

Critical Race Theory?

Is that the new PC term for Black Liberation Theology?

Remember obama saying this, now makes more sense:

Obama on picking Judges:

.."We need somebody who's got the heart, the empathy, to recognize what it's like to be a young teenage mom. The empathy to understand what it's like to be poor, or African-American, or gay, or disabled, or old. And that's the criteria by which I'm going to be selecting my judges."

"The Repubs could have blocked Kagan, and Sotomayor.....they were cowards, and now we have 2 communists on SCOTUS."

They could have easily blocked Obama before he took office on Article II eligibility grounds. Even now, with clear evidence of fraud and forgery committed against We the People, they turn their backs to the very same Constitution that they swore a sacred oath to protect and defend.

Maybe; that covers Sottomyer. But I don’t see any affable dykes; that leaves Kagan out in the cold...
