It's been around since before 1991 and Barack Obama at Harvard Business School, but you had no reason to hear of it unless you are a lawyer who was interested in certain issues. For example, it frequently came into play for years in a sort of 'affirmative action' when granting tenure to law professors.
Leftists tried to argue that black professors who spouted fiction in this area were equally suited for tenure as older, experienced white professors who had written many multiples of scholarly articles.
In appellate briefs, critical race theory attorneys didn't believe in using traditional logic - they believed that fictional stories should hold as much value as actual facts and precedent. Critical race theory means you don't have to do research or site facts.
I have a book from 1995 that touches on critical race theory at Harvard Law School.

Laws that pertain equally to everyone in American society are racist and unjust to Black people. Designed with racist for-thought to keep Blacks down or better yet, in prison.
