Obama's DOJ strikes again: Swimming pools need wheelchair lifts.
The Washington Examiner ^ | 3/13/2012 | Conn Carroll

Posted on 03/14/2012 11:25:37 AM PDT by dmzTahoe

President Obama's Department of Justice -- led by Attorney General Eric Holder -- has found a new way to make the Americans with Disabilities Act pay off for Democratic trial lawyer campaign donors...

The DOJ has been issuing a growing wave of such guidelines over the years, reaching an ever larger portion of business activities. In September 2010, the DOJ issued guidelines for "recreational facilities," including a new rule that all public access swimming pools must provide a lift capable of moving disabled patrons from their wheelchairs into the water...

On Jan. 31 of this year, DOJ granted the industry's call for a clarification: But it was not the answer they wanted. All 300,000 public pools in the United States must install a permanent fixed lift. The deadline for compliance is tomorrow, March 15. Call it "Poolmageddon."

So what happens tomorrow when a disabled individual checks into a Holiday Inn and finds no lift at the pool? The Obama DOJ has said it will not be enforcing the new guidelines right away. That means no fines from the government, for now.

But the ADA also empowered citizens to sue businesses that are not in compliance with DOJ guidelines. The result will be a huge payday for enterprising trial lawyers everywhere....

This will certainly mean the closing of the Middle School pool which is open to the public in our town. The school system is at a breaking point and I am sure there are zero funds available for this communist stupidity.

These vile maggots are pushing the Cloward and Piven strategy to the very limits to collapse the system.

Could use this for our advantage... hot, long summer... cities close all swimming pools due to this regulation... November vote. Another example of an out of control DOJ. If only we had a candidate that would add this to the campaign stump.

"This will drain public swimming pools faster than a floating Babyruth"

In California they passed this thing called the "Deep Pockets" law, i.e. if multiple people are at fault for an accident the one with the most money (not the most at fault) gets to pay most of the damages.

If little Johnny got hurt from being pushed off the top of a slide by little Bobby and little Bobby's parents were destitute, then the city got to foot the bill.

It was only a few months before all of the playground equipment at all of the public parks was put off limits or removed.

A lot of time, people who need wheelchairs also don’t have bowel or bladder control.

LOL. I guess we need Bill Murray to clean this up. Carl Spackler, the groundskeeper, for President.

Have you not been paying attention? Newt is the ONLY candidate sharing plans and details to fix this country, the others are empty suits.

So when will wheelchair elevators be installed on diving boards at swimming pools? Oh, wait! Diving boards have been removed because they pose a danger to swimmers. - Carl Vehse

In what edenic paradise do you live where they still allow diving boards? - who_would_fardels_bear

Care to read it again?

plus, there is a liability issue by not having a lifeguard on duty if the lift is misused, causing injury. You can imagine the attraction the lift will have for unsupervised kids.

You're doing it wrong.

All the executive branch has to do is decree that all pools have a lifeguard on duty 24/7, then mandate that these lifts have specially designed cages to keep unsupervised kids off.

See how easy this is?

Our town put in a lift in 2001. That’s good, but my gracious what a lot of trouble for the one or two people that might use it.
