President Obama's Department of Justice -- led by Attorney General Eric Holder -- has found a new way to make the Americans with Disabilities Act pay off for Democratic trial lawyer campaign donors...
The DOJ has been issuing a growing wave of such guidelines over the years, reaching an ever larger portion of business activities. In September 2010, the DOJ issued guidelines for "recreational facilities," including a new rule that all public access swimming pools must provide a lift capable of moving disabled patrons from their wheelchairs into the water...
On Jan. 31 of this year, DOJ granted the industry's call for a clarification: But it was not the answer they wanted. All 300,000 public pools in the United States must install a permanent fixed lift. The deadline for compliance is tomorrow, March 15. Call it "Poolmageddon."
So what happens tomorrow when a disabled individual checks into a Holiday Inn and finds no lift at the pool? The Obama DOJ has said it will not be enforcing the new guidelines right away. That means no fines from the government, for now.
But the ADA also empowered citizens to sue businesses that are not in compliance with DOJ guidelines. The result will be a huge payday for enterprising trial lawyers everywhere....

I went to North Point High School in Waldorf the other day and one of the things I noticed was a ramp down one side of the pool for handicapped.
I suppose it wouldn’t cost too much when you are building a large municipal pool to include a ramp, but of course trying to put one in a pool already built would be kind of tough, and expensive.
It isn’t so hard getting them in, just take them to the edge and lift the back of the chair. Getting them out is the problem.
Hey, right now it’s public swimming pools. Next, it’ll be private pools. Then finally ponds, lakes and oceans. I’m sure that right now Holder has some junior attorneys trying to figure out how to sue God.
FWIW, there are a couple of lawyers in the SF Bay Area whose entire career is based on shaking down restaurants for ADA facilities both in rest rooms and for wheel chair access to the door. They usually get a settlement of $50-100k. Like taking candy from a ...
Reminds me of that nasty add the Dems ran of Repubs tossing a wheelchair bound old lady over a cliff. Maybe we should demand lifts on cliffs so entry would be easier...
1. Price the cost of a pool lift.
2. Price the cost of a construction company filling the pool with dirt.
Invest in the cheaper option.
I visited Russia in ‘88, and had a real KGB tour guide. We stopped at the huge municipal pool in Moscow and listened to her talking about how the pool was for the public, free, open 24/7, etc, etc.
Only problem: the pool was empty and looked like it had been empty for a long time. The guide acted like she couldn’t see that it was empty.
Buy stock in companies that fill in pools. There already doing great business due to the number of expensive regulations and high insurance costs. Many people are just saying "Forget it" ....especially apartment owners.
It’s hard not to notice that 10 foot diving boards are a thing of the past too. Same reason, fear of litigation.

Bush the Younger signed the amendments (ADAAA) into law in September of 2008.

That sound we hear is the slamming of dozens of low budget swimming pools all over the United States closing their doors to recreational swimmers - many, if not most of them, kids.

An outcry was raised at our 1967 Centennial Library, because of the steps from the ground to the actual floor. About ten feet of steps. With the usual ceremony, an elevator was installed. One has to go upstairs and procure a key for that elevator. I have never seen the elevator used. Never and I am a once a week patron, this was over twenty years ago. It looks as if one has to jump through the hoop to use it. I wiil ask tommorrow how often it is used, but not to make any point.
We see numerous parking spaces for the handicapped all over town. Often empty and some smarty using the sticker cos' grandma might be with them. Jammed and packed at Tim Hortons coffee shop and handicapped parking empty. 100 dollar fine for using illegally.
Trust the zealots with authority, to barge in an ruin people's best efforts. People who would use tact and commonsense in any case being berated about "rights".
