Obama's DOJ strikes again: Swimming pools need wheelchair lifts.

President Obama's Department of Justice -- led by Attorney General Eric Holder -- has found a new way to make the Americans with Disabilities Act pay off for Democratic trial lawyer campaign donors...

The DOJ has been issuing a growing wave of such guidelines over the years, reaching an ever larger portion of business activities. In September 2010, the DOJ issued guidelines for "recreational facilities," including a new rule that all public access swimming pools must provide a lift capable of moving disabled patrons from their wheelchairs into the water...

On Jan. 31 of this year, DOJ granted the industry's call for a clarification: But it was not the answer they wanted. All 300,000 public pools in the United States must install a permanent fixed lift. The deadline for compliance is tomorrow, March 15. Call it "Poolmageddon."

So what happens tomorrow when a disabled individual checks into a Holiday Inn and finds no lift at the pool? The Obama DOJ has said it will not be enforcing the new guidelines right away. That means no fines from the government, for now.

But the ADA also empowered citizens to sue businesses that are not in compliance with DOJ guidelines. The result will be a huge payday for enterprising trial lawyers everywhere....

If I were CEO of a major hotel chain, or owner of a single motel with a pool, I would close guest access to the pool and inform all guests that Obama and his out of control DOJ were the reason. I would think the outrage would spread like wildfire.

What going happen if you have one of disabled right person and want swim in the pool RIGHT NOW you don’t have that would you still be sue

In my state California i think so

Quick money for the scum sucking attorneys and their entitled clients... just find someone in a wheelchair and check in at a Holiday Inn, orr a big hotel in Vegas (Bellagio or the Wynn). Deep pockets and “law breakers” per the DOJ.

This will drain public swimming pools faster than a floating Babyruth. Small towns like mine can barely afford to have a public pool. This additional cost will be too much.

All these hotel pools are built intentionally small since most jurisdictions require a lifeguard (or even two) over a certain square footage.

I can only imagine that providing a lift for a wheelchair user i.e. a handicapped person would require a lifeguard as well. There is no ‘swim at your own risk’ when someone requires assistance simply to enter or exit the water.

This is like building a wheelchair ramp access onto a skating rink, which was done in the People’s Republic of Austin a few years ago.

So when will wheelchair elevators be installed on diving boards at swimming pools? Oh, wait! Diving boards have been removed because they pose a danger to swimmers.

Next, the Obamagestapo will order the water drained from pools because of documentation that it is the major cause of pool drownings.

plus, there is a liability issue by not having a lifeguard on duty if the lift is misused, causing injury. You can imagine the attraction the lift will have for unsupervised kids.

Exactly, they just killed off most of the public pools, however that is defined. If it affects city/county/state parks, then Holder’s people may be hit the hardest. What a bunch of effin wanabe kings we have running (ruining) the country.

the closing of the pools will happen for sure. I doubt though any corporate CEO will make a peep about Obama.

The ruling also includes spas... so if there is a pool and a spa, they need two seperate lifts. And the lifts need to be permanent, ruling out the use of a portable one.

Government regulation, especially Federal have been stupid for a long time!

I spent ten years commuting to DC via the MARC train. Was always annoyed because there were never enough working toilets on the train. The individual car toilets were always locked. If you take heart meds, which I do, you have to visit the accommodations much more often. Seems federal regulations requires that the toilets be locked if everyone, including wheelchair bound, can’t use the facilities. Yeah, makes a lot of sense to force someone to disembark or piss from the train platform! Both, of which, I’ve done. Funny thing, a man can pee anywhere!

at $10,000 a lift, one each for a pool and spa... large chains have how many pools and spas? I would think this would cause a few CEO’s some concern.
