Jury finds Va. Tech negligent in '07 shootings

CHRISTIANSBURG, Va. (AP) — A jury has found Virginia Tech negligent for delaying a campus warning of the first shootings in a 2007 campus massacre that left 33 dead.
Jurors returned the verdict Wednesday in a wrongful death civil suit brought by the parents of two students who were killed on April 16, 2007, in the most deadly mass shooting in modern U.S. history.
Jurors deliberated for 3 ½ hours before awarding $4 million to each family, and the state immediately filed a motion to reduce the award. State law requires the award to be capped at $100,000.
The families of Erin Peterson and Julia Pryde said the two might be alive today if Virginia Tech police and administrators warned the campus of two shootings in a dorm 2 ½ hours before Seung-Hui Cho (sung wee joh) ended his killing spree, then killed himself.
Virginia Tech officials said they believed the first shootings were isolated.

Damned straight DC!
Nothing will ever bring back these children to their parents. I don’t know how you place a monetary figure on it. I also don’t know if students need to be e-mailed with every possible threat that springs up on a major campus.
May God comfort these families.
Another damn judge doesn't know the law or doesn't give a damn. This judge should be impeached.
Those young adults hid under their desks while he walked from person to person shooting them. They even laid there while he was reloading.
If any one of them had fought back the death toll would have been much lower. They could have thrown books, chairs, anything at all. But no, they have been taught since grade school not to fight back.

Exactly. A few years ago, some nut started shooting up a college in Israel. I can’t remember if he killed anyone or not, but a student who was carrying took him out in short order. No way to tell how many lives were saved.
It's not uncommon in many states to submit the case to the jury without telling them the applicable cap, and for the judge to then reduce the verdict if it exceeds the cap. Otherwise, if you tell the jury that the maximum award is $100,000, many jurors will think that that figure is so low they will disregard the possibility of finding for the defendant on the issue of liability.

Then why the anti-rights policy for an isolated incident?
People are resposible for their own defense. If we still believed in self discipline and responsibillity this case would have been thrown out.
This wasn’t even about defense. The argument made (and which won) seems to be that, if Tech had simply done a campus-wide announcement of the shooting, that these two students would have skipped classes and not been shot.

DENVER — Courts are ruling in favor of allowing those with concealed-carry permits to bring their handguns on campus, but universities are figuring out ways to keep the guns out.
In response, however, university officials in Oregon and Virginia have enacted policies allowing concealed carry on campus but not in buildings, including classrooms, dormitories, event centers and dining halls.
The result is that permit holders may do little more than walk across campus with their handguns, an outcome that circumvents the intent of the court decisions, critics say.
Kurt Mueller, chief liaison for Students for Concealed Carry on Campus, said the organization is considering whether to challenge the university policies in court.
“We have enormous practical concerns about this,” Mr. Mueller said. “If you’re a student, as a practical matter, what this means is you have to leave your handgun in your car. And a lot of states say you can’t leave a handgun in your car, which means you have to leave it at home.”
