Health-Care Challenge Evokes Roosevelt New Deal High Court Clash

In reviewing Barack Obama's health care overhaul, the U.S. Supreme Court has pushed into territory it hasn't approached since the days of Franklin D. Roosevelt.

"This is a central challenge to the modern Constitution, which was fashioned during the New Deal and then elaborated further during the civil rights revolution," said Bruce Ackerman, a professor at Yale Law School in New Haven, Connecticut and author of "The Decline and Fall of the American Republic" and 14 other books. "This goes to the very foundations of modern American government."

The court will determine whether the government can force millions of people to obtain insurance. The decision may influence the outcome of November's presidential election. The potential legal impact has few parallels in the court's history.

There is no way to know in advance. The "constitutional or not" decision is only made after the encroachment.

Why did the constitution need to be amended to prohibit alcohol, but not for a federal prohibition against pot? Answer, "New Constitution," made up by SCOTUS.

You cannot rule out a tortured reading of the Case, and that Scalia was at the recent Party for The Messiah over the past weekend, for a reason.

There are NO guarantees with the USSC, regardless of WHO is supposedly "Conservative", and 3 votes ALWAYS go Democrat/Progessive/Liberal now (Kagan who is deeply involved in the crafting or the very Law that will be ruled upon, which CLEARLY requires a Recusal, but will not happen), and Sotomayer and Ginsberg. Breyer is NOT a Conservative at all, and Kennedy is a crap-shoot. It could go 6-4 in favor of the Obamacare Case being held Constitutional, or even 7-3. I don't put my faith in fairness or proper Constitutional interpreatation at all, any more.

NO ONE challenged The Messiah on all his EO's, Regulatory Mandates, nor his creation of the un-Elected, un-accountable Czars. Holder basically only enforces Laws selectively, of "His People", and DOMA and Illegal Alien laws are totally ignored.

The Messiah is the term used to describe the adoring populace that loves the King of the USA, because he’s BLACK, and because “he gives us stuff”; like “OBAMA MONEY....from his STASH”

It would not be the end game any more than the Dred Scott decision was.

BS! It would mean immediately that the Legislative and Executive branches of government are allowed to unilaterally control every aspect of your life and CHARGE you for it via taxes.

If SCOTUS doesn't strike it down, America is done. Game over. No replays. No extra men. It's just over. It's a hardened, inedible shell of a country run by men instead of laws.

Our Founders are absolutely apoplectic at this point. America's death rattle is becoming more pronounced every day.

Not if the nation comes to its senses and realizes the error of it’s ways. Constitutional amendments could be enacted to end such foolishness. It’s never over till it’s over!

You’re banking on an American electorate that put this current clown in the Oval Office. Those among us who are responsible, caring citizens understand the gravity of this situation, but the average muck on the streets couldn’t care less who’s occupying DC as long as they “get theirs.”
