Mayor says he'll suspend Mirkarimi as sheriff

Mayor Ed Lee is suspending Sheriff Ross Mirkarimi from his post, the first step toward removing him from office permanently for official misconduct.

"He has chosen not to resign and now I must act," Lee said in a 5 p.m. news conference today. He said the sheriff's actions "fell below the standard of decency and good faith" needed for public officials.

Mirkarimi pleaded guilty last week to a misdemeanor charge of false imprisonment for an incident involving his wife on New Year's Eve.

Lee named Vicki Hennessy to serve as interim sheriff. Hennessy last ran the Department of Emergency Management after a career in the Sheriff's Department, where she retired as chief deputy.

Lee told Mirkarimi Monday afternoon that he had 24 hours to resign voluntarily, but the embattled sheriff, who was elected in November and sworn in Jan. 8, refused the request and will fight the official misconduct charge.

San Francisco has a sheriff? You’re kidding. Does his uniform consist solely of boots, chaps, a handkerchief, a cowboy hat, and nipple rings? :-)

See? Even with a relatively small office like Sheriff of San Francisco, once a Democrat gets his hands on power you have to pry it from his fingers to get it back.

So, the Mayor of a large city thinks he can “suspend” and/or “fire” an elected Sheriff? This will not end well.

Mirkarimi is a marijuana legalization advocate, and co-founder of the Green Party of California.
Mirkarimi helped establish the Green Party and was a manager of its 2000 presidential candidate, Ralph Nader. He left the Green Party in March 2010 to become a Democrat.[2]
Mirkarimi served on the California Coastal Commission from 2009 to 2011. On April 20, 2006, Mirkarimi was awarded the National Organization for the Reform of Marijuana Laws’ (NORML) Rufus King award, given annually for leadership in the reform of marijuana laws.[3]

From whence does a mayor of a city derive authority to suspend a sheriff, who I assume is the chief law enforcement officer of a county? Or is California’s civic order (?) structured differently from that of other states?

I think SF is a city and a county all in the same boundaries. What the mayor can or can’t do I don’t know.

I admit that I don’t understand CA laws and politics, but I really don’t comprehend how a city Mayor can remove and elected County Sheriff from office.

Aren’t all County Sheriffs elected by the citizens and serve as the top law enforcement officers in their respective Counties? If the answer is ‘yes’, then they are not subordinate to some city Mayor.

The Sheriff’s run the jails and provide court security in California. Mirkarimi was elected, and the Mayor can’t suspend him. The mayor better be careful because if he oversteps his lawful authority, Mirkarimi can have him arrested.

I am confused. Isn’t the Sheriff elected? How can you “suspend” an elected official. Isn’t a sheriff the highest elected official in a county? What is a mayor doing?

Of course it is happening in La La land.
