A cousin of Oscar Grant, shot in the back by an Oakland police officer last month, filed a lawsuit in federal court Wednesday against the City of Oakland.

Tony Jones, a 24-year-old Oakland resident, is seeking $10 million in connection with the incident that occurred close to midnight Feb. 19 on the 2000 block of 62nd Avenue.

"After reviewing the police report, it is patently obvious that this shooting was unjustified, and that the police department has been working feverishly in an attempt to cover the illegitimacy of the shooting," Jones' attorney, Waukeen McCoy, said in a prepared statement.

Police have said that Jones tried to flee the scene of a robbery investigation, and that the officer fired at him only after seeing Jones turning toward him with a gun in his hand.

Jones, who has a lengthy criminal record, was charged with four felonies stemming from the police investigation including armed robbery. He is being held at Santa Rita Jail.

The lawsuit alleges that officers violated Jones' civil rights and intentionally inflected emotional distress on him.

The Occupiers renamed Frank Ogawa Plaza "Oscar Grant Plaza" during their occupation. In her infinite wisdom, Oakland mayor Jean Quan had the police stay away.

'Welcome' sign Occupy Oakland Oct 18 2011, Frank Ogawa Plaza has be renamed "Oscar Grant Plaza" by some of the Occupy Oakland protesters. Oscar Grant wikipedia link: http://en.wikipedia.org/wiki/BART_Police_shooting_of_Oscar_Grant
