CNN Senior Legal Analyst Jeff Toobin: This still looks like a train wreck for the Obama Administration, and it may also be a plane wreck. This entire law is now in serious trouble. It also seems that the individual mandate is doomed. I mean, Anthony Kennedy spent much of this morning talking about if we strike down the individual mandate, how should we handle the rest of the law? Now, it is less clear that they are going to strike down the whole law. There does seem to be some controversy in the court about that. Certainly there are some members of the court, Antonin Scalia, Justice Alito, who want to strike down the entire law, but it seemed almost a foregone conclusion today that they were going to strike down the individual mandate, and the only question is does the whole law go out the window with it?

A bad day for Obama is a good day for America...
What is it exactly that the Constitution says, in a word, on the powers of the Judiciary Supreme Court which implies that the Court actually has no powers. The Supreme Court may “recommend”, or advise, I can’t remember, but they can neither legislate, nor enact.
Do you know what I mean?
Can Obama use that vague wording and simply choose to reject their recommendation or advice, whatever that word is, and enact as he chooses and based on the already passed legislation by Congress?
The Solicitor General could have stood in front of SCOTUS and not said a word and the 3 liberals would still support the regime.
There will be no “stake throught the heart” with this decision, merely a speed bump IMHO. Congress need to kill this bill once and for all. But that probably won’t happen.
correction..4 liberals
“John Marshall has made his decision, now let him enforce it!” ~ Andrew Jackson (reportedly but never verified)
I can imagine it going worse for Obama. Fifteen minutes after the summation arguments, all nine justices appear on the steps of the building with the law and use it to warm their hands as it burns in an ash can.
By the way, why doesn’t Obama just issue and Executive Order saying the law will stand regardless of what the Supreme Court says? I’m certain he has no problem with something akin to such an act.
Which is why I've never been as optimistic (lately) as I am today.
Jimmy Carter redux. 1979-80 redux.
Or as I like to say, the SG could have stood in front of the Court naked with a feather duster up his ass and still get those same 3 votes.
BRAVO!
Hard To Imagine How Things Could Be Going Worse For Obama Administration
I don’t think our imaginations are so limited. I can imagine many more things that could be worse for the administration than the defeat of Obamacare. Hopefully this defeat will only be the beginning of the end for this regime.
In a sick kind of way getting this tossed may actually help Obama.
Millions of nominal Catholics will no longer be getting messages from the pulpit about mandates to supply birth control. They will then be free to go back to voting their union newsletter as they’ve always done.
The best effect of striking down 0-care might be a nervous breakdown for hussein. Headline: obamacare care gets an ‘F’. He has his name on it and the grade is ‘F’! Quite a setback for a ‘major university professor’ once touted as an expert on the Constitution.
Look what the Leftists are doing to the current SJ right now after seeing his pathetic and flailing arguments.
SJ should be SG.
I’d give SCOTUSblog or Volokh commentary some weight. Toobin is a moron.
