Romney’s Record on Judicial Appointments: Can he be trusted to appoint conservatives to Courts?

Summary: Mitt Romney’s record as Governor does not indicate a commitment to a conservative judicial philosophy.

His judge appointees revealed at best “no philosophical or partisan pattern” (Boston Globe), or at worst a liberal and even radical tilt. He sought out feminists and radical homosexual groups in his judicial selection process. He was inconsistent in his pronouncements on judicial activism, allowing it to occur under his watch (with “gay marriage”) while simultaneously urging others to fight it. How then could we expect him to keep his recent promises to appoint constitutional conservatives to the bench if he is elected President?

What sort of attorneys would he name to his Justice Department? As Governor, his Chief Legal Counsels advised him to implement unconstitutional policies: implementing “gay marriage” without legislative authorization, and forcing Catholic hospitals to dispense morning-after abortion pills.

Are achieving “diversity” and “non-discrimination on the basis of sexual orientation” still core values for Romney in his appointments?

It’s a 100% certainty that Obama won’t.

It’s a 100% certainty that Obama won’t.

Now there's a ringing endorsement for voting for a left-wing, Progressive Liberal like Romney!

“The Massachusetts Republican Party died last Tuesday.
The cause of death: failed leadership.

The party is survived by a few leftover legislators
and a handful of county officials and grassroots activists
who have been ignored for years.
Services will be public and a mass exodus of taxpayers will follow.
In lieu of flowers, send messages to Republican voters
warning them about a certain presidential candidate named Romney.”

- Boston Herald, 11/12/2006

"In 2006, while Romney was chairman of the National Republican
Governors Association - a group dedicated to electing more
Republican governors - his own hand-picked Republican successor
as governor lost badly to the Democrat, despite the fact that Republicans
have held the governorship in Massachusetts since 1990. Romney largely
ignored the Massachusetts elections and spent most of the time
during the campaign out of state building his presidential campaign.
He came back and publicly campaigned for the Republican candidate
the day before the general election!
“Locally, this is a rebuke to Mitt Romney and checking out within six months
after being elected and having accomplished almost nothing,”

[Jim] Rappaport [former chairman of the state Republican Party]."
- Boston Globe, 11/8/2006

"Governor Mitt Romney, who touts his conservative credentials to out-of-state Republicans,
has passed over GOP lawyers for three-quarters of the 36 judicial vacancies he has faced
,
instead tapping registered Democrats or independents -- including two gay lawyers who
have supported expanded same-sex rights, a Globe review of the nominations has found.
Of the 36 people Romney named to be judges or clerk magistrates, 23 are either registered Democrats
or unenrolled voters who have made multiple contributions to Democratic politicians
or who voted in Democratic primaries, state and local records show.
In all, he has nominated nine registered Republicans, 13 unenrolled voters,
and 14 registered Democrats."
- Boston Globe 7/25/2005

Romney Rewards one of the State's Leading Anti-Marriage Attorneys by Making him a Judge
Romney told the U.S. Senate on June 22, 2004, that the "real threat to the States is not the
constitutional amendment process, in which the states participate,
but activist judges who disregard the law and redefine marriage . . ."
Romney sounds tough but yet he had no qualms advancing the legal career of one
of the leading anti-marriage attorneys.
He nominated Stephen Abany to a District Court.
Abany has been a key player in the Massachusetts Lesbian and Gay Bar Association which,
in its own words, is "dedicated to ensuring that the Massachusetts Supreme Judicial Court decision
on marriage equality is upheld, and that any anti-gay amendment or legislation is defeated."
- U.S. Senate testimony by Gov. Mitt Romney, 6/22/2004 P>

"Romney announces he won't fill judicial vacancies before term ends
Despite his rhetoric about judicial activism, Romney announced that
he won't fill all the remaining vacancies during his term - but instead
leave them for his liberal Democrat successor!

Governor Mitt Romney pledged yesterday not to make a flurry of lame-duck
judicial appointments in the final days of his administration . . . David Yas,
editor of Lawyers Weekly, said Romney is "bucking tradition" by resisting the urge to
fill all remaining judgeships. "It is a tradition for governors to use that power to appoint judges
aggressively in the waning moments of their administration," Yas said.
He added that Romney has been criticized for failing to make judicial appointments.
"The legal community has consistently criticized him for not filling open seats quickly enough
and being a little too painstaking in the process and being dismissive of the input of the
Judicial Nominating Commission," Yas said.

It’s 100% certain that Obama can’t be trusted and 98% certain that Romney can’t be trusted. I’ll be voting for the most conservative candidates for the House, the Senate, and almost every race, but I don’t see a difference that matters for the Court or for legislation between Romney (a leftist who doesn’t hate America) and Obama (a less capable socialist who intensely hates America).

No more or less so than those hereon who try to sell the preposterous concept that it would actually be better to have Obama in the WH for the next 4 years.

Well, that’s you. I am a Newt supporter, but I do see a difference between someone (anyone) who doesn’t hate America and someone who does.

You are promoting a left-wing, Progressive Liberal for POTUS who cannot win because he is a left-wing, Progressive Liberal on a conservative website.

That is the definition of insanity.

Keep hitting your head against the wall, maybe, just maybe, you might come to your senses and join the rest of us conservatives in doing our dead-level best in making sure that BOTH Obama and Romney do not become President.

How about you read my post #10 before your start your pompous finger pointing? I’m saying NO ONE is worse than Obama, and no amount of name-calling is going to change my mind about that. My entire family voted for Newt in the primary and I still contribute to his campaign. Now, why don’t you go hit your head against a wall?

He’ll have no mandate to do otherwise after the fight conservatives are putting him through. No way he will dare put a lib on the court — especially if the SC tosses out obamacare.

Okay. So if Romney IS the nominee then what? Allow Obama to win? This conservative nominee or no one dogma isn’t going to work. To not vote for the Republican candidate will be playing with the fire of an Obama presidency without the limits of a first term. Don’t want to go there.

I would prefer Santorum or Gingrich, but in the end, if Romney is the candidate, people WILL vote for him.

What does your post #10 and you and your family voting for Newt have to do with your promoting of Mitt?

You are still advocating a vote for Mitt by your posts on this thread.

For anyone who pays attention, it's obvious that Romney can't be trusted on this subject or any other.

He is toxic and will kill the GOP nationally just like he did in Massachusetts.

If Romney is the nominee, we all lose, he loses.

With Romney's extensive, left-wing, Progressive Liberal Record, Obama and his minions in the MSM will have no trouble destroying his candidacy.

Just a part of Romney's left-wing record:

1. Implemented and supported Gay Marriage
2. Supported and forced Gay Adoption
3. Supported the Brady Bill
4. Implemented a state-level "Assault" Weapons Ban AFTER the Federal AWB was allowed to expire.
5. Supported TARP
6. Believes in Man-Made Global Warming.
7. Supported a state level Cap-and-Trade system in MA.
8. Supported Amnesty for Illegal Aliens (pathway to citizenship) 9. Raised taxes/fees by 300% while governor of MA.
10. Implemented a Socialist Health-Care program in MA called RomneyCare with $50 dollar Abortions and an Individual Mandate.

And you are right, people will vote for him, but not enough to keep Obama winning in landslide proportions.

Furthermore, do you really want to be put into the position of having to convince conservatives that they must vote for "the Father of Gay Marriage in America"?
