Most likely the vote was 5-4 to kill Obamacare. Should one of the 5 suffer a fatal "accident" or "heart attack" or "assassination by a right winger" before the final ruling, a new vote would be required. This would result in a 4-4 tie, thereby preserving Obamacare. Or the case might be reheard after a replacement is appointed by Obama and the Democrat Senate. This is why the House is not merely authorized but REQUIRED to impeach a criminal president like the one we have.

What good would that do? The HR can impeach the president all they want, but it is the Senate that tries, convicts, and removes from office.
