Prosecutor rules out grand jury in Trayvon Martin case

The special prosecutor investigating the shooting death of unarmed Florida teenager Trayvon Martin on Monday ruled out using a grand jury in the case, meaning her office alone will decide whether to charge shooter George Zimmerman with a crime.

The case has captured national attention because of race and Florida's controversial self-defense laws, prompting demonstrations across the country including one on Monday that temporarily shut down the Sanford Police Department in the town where the shooting took place.

Martin, 17, was black and Zimmerman, 28, who has not been charged, is white and Hispanic.

Sanford police declined to arrest Zimmerman after the shooting, saying they found no evidence to contradict his account that he acted in self-defense. Police cited Florida's "Stand Your Ground" law, which allows people to use deadly force against adversaries when they fear great bodily harm or death.

But defense lawyers with experience litigating "Stand Your Ground" cases say Zimmerman, if he is charged, faces significant challenges in order to assert immunity under that law....

Can someone show me a "mainstream" media story on this subject that doesn't editorialize strongly in favor of Trayvon Martin and against George Zimmerman? I've read hundreds of these in the last month and still haven't seen one.

Yahoo is as neutral as you are going to find. At least there is usually a clear separation between facts and opinion (editorializing)

The lynch mob will not be denied. The special prosecutor will cave and charge him with a lesser charge of manslaughter or 2nd degree murder. Witnesses will miraculously appear, evidence will disappear, etc. and George will be made available to the public and MSM lynch mobs.

I would think that a Grand Jury would see this case without the political overtones. Not really sure if a single Prosecutor could to the same. We may be in line for a political decision - just what we need!

The fifth amendment says that "no person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury..."

I guess that means that they don't need to use a grand jury if they aren't asking for the death penalty. If he is sentenced to prison, that could mean death at the hands of another prisoner.

The sixth amendment promises a public and speedy trial "by an impartial jury of the state and district wherein the crime shall have been committed." But if there was no crime committed, he isn't entitled to an impartial jury.

Its pretty sad that DEM are willing to scapegoat/harm/jail one of their own to prove that America is a racist country . Zimmerman is a democrat

Hmmm. Pretty easy to bring a grand-jury indictment. As I recall, all the evidence presented is by prosecution, and all the accused can answer is "yes" or "no." I believe the expression is that any DA worth his salt could get a ham sandwich indicted. I'd say it indicates they don't have the evidence they think will get enough jury votes for an indictment.

The lack of evidence will still be a problem if they try to prosecute this without an indictment. And it looks as if the Trayvon claque has shot their wad on wild claims about the case. All they have left is calls for race war. This won't look good if they try to push a real prosecution. Zimmerman and his family are unlikely to take this lying down; in fact, they're just warming up.

anyone got any info on some supposed ‘new witnesses’ that have coem forward agaisnt zimmerman? I hweard just aquick blurb on tv today about it but haven’t been able to find any more info on this? I know abotu the 2 women who ONLY saw the dfight as it ended and who ignorantly accused zimmerman of not caring about the facvt that martin was dead- but I haven’t heard anythign more about ‘new witnesses’? Seems odd that they would just now be coming out if infact htere are new witnesses?

If there is no grand jury, will the charge against Zimmerman (and it will be coming because of national “public opinion”) be a misdemeanor?

Yeah. On liberal sites, whenever Obama’s race comes up, I always point out that he is Mulatto.

When someone calls me on it as in “why is it so important to you?” my response is, “It’s not, but if you guys are going to keep bringing his race into everything, you should be accurate. He is as much a white man as he is a black man.”

Really irritates them.
