9-11 defendants use courtroom to torment victims' families

“Justice delayed is justice denied” is a maxim generally attributed to 19th century British Prime Minister William E. Gladstone. We’ve heard that phrase often, and the Sixth Amendment to the U.S. Constitution is based on this principle. “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial,” it provides. Let’s place “speedy trial” on the back burner for a moment as we consider Saturday’s arraignment of Khalid Shaikh Mohammed.

Here’s a brief timeline of the life of Khalid Shaikh Mohammed, the self-proclaimed mastermind of 9/11, since his capture and custody at the military prison in Guantanamo Bay, Cuba:

KSM was captured in March 2003, allegedly through a text message sent by an informant to U.S. authorities. After being subjected to enhanced interrogation, including waterboarding, he cooperated with his CIA handlers. Although he didn’t give up a lot of information, it was enough to eventually lead to Osama bin Laden’s death.

Like the "missteps" in the Major Hasan case? Over two feckin' years now and WTF is the trial?
Someone better put Holder on trial - fast!

The incredible thing about the Hasan case is what a slam dunk treason prosecution it would be if the Illegal were a real American genuinely devoted to protecting Ameica and its citizens. The first paragraph of Article III, Section 3 of the Constitution states:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless, on the testimony of two Witnesses to the same overt Act, or on Confession in open court.

Although this is a very restrictive standard for conviction, Hasan fits it perfectly. His act of murdering 13 people in public in front of many witnesses while yelling, "Allah Akbar!" was definitely an act of war against the U.S. and was witnessed by more than enough people to fulfill the constitutional standard. Add to that his repeated pro-Jihadi rants in front of large audiences that constituted both: 1) giving aid and comfort to our Islamist enemies and 2) compelling evidence of anti-American animosity that would establish he intended to wage war against the U.S. by the mass murders he committed, and you have a slam dunk treason case that could have been tried and won within a few months after the actual crime.

Indeed the present, fictitious "workplace shooting" rationale being offered by the Administration is dangerously weak and might expose it to an insanity defense. Worst of all, it ignores Hasan's treasonous motive. That leaves the prosecution touting a fictitious explanation for his conduct in the form of some kind of adverse personal interactions that led him to "snap." It's not likely to work. The defense will be able to jump on that pile of B.S. like a tarantula on a bug and use it to show Hasan had no sane, but evil, reason for his acts, thereby opening a huge door for an insanity defense.

That being the case, the compelling question is, "Why didn't Obama authorize such a totally appropriate, easily winnable treason prosecution?" The only logical answer is he is a traitor who's determined to give as much "Aid and Comfort" to our Islamist enemies as he possibly can.

Too bad some real American (aka NOT Holder’s people) does not bring into the court some pretty women in short, but not courtroom inappropriate skirts, and low cut but tasteful tops and hand them all some pulled pork sandwiches wrapped in pages torn from the Koran.

Maybe someone with a seeing eye dog should attend.

Anyone not eating a pulled pork sandwich could also be adorned with a Star of David.

Just letting the mind wander here.

I'm always reminded of the Nazi saboteurs who landed on LI in June 1942.
They killed no one, committed no damage, but were tried/convicted by a military commission and executed in August 1942.
That's justice.

Diogenesis, being an honesty man, you can apprecate the fact that when I used the term “missteps,” I was merely being nice. BTW, why is it that it’s always conservatives who bend over backwards to be nice, and never liberals?
