Drop George Zimmerman’s murder charge
nydailynews.com ^ | 18 May, 2012 | Alan Dershowitz

A medical report by George Zimmerman’s doctor has disclosed that Zimmerman had a fractured nose, two black eyes, two lacerations on the back of his head and a back injury on the day after the fatal shooting. If this evidence turns out to be valid, the prosecutor will have no choice but to drop the second-degree murder charge against Zimmerman — if she wants to act ethically, lawfully and professionally.

There is, of course, no assurance that the special prosecutor handling the case, State Attorney Angela Corey, will do the right thing. Because until now, her actions have been anything but ethical, lawful and professional.

She was aware when she submitted an affidavit that it did not contain the truth, the whole truth and nothing but the truth. She deliberately withheld evidence that supported Zimmerman’s claim of self-defense. The New York Times has reported that the police had “a full face picture” of Zimmerman, before paramedics treated him, that showed “a bloodied nose.” The prosecutor also had photographic evidence of bruises to the back of his head.

But none of this was included in any affidavit.

Now there is much more extensive medical evidence that would tend to support Zimmerman’s version of events. This version, if true, would establish self-defense even if Zimmerman had improperly followed, harassed and provoked Martin.

A defendant, under Florida law, loses his “stand your ground” defense if he provoked the encounter — but he retains traditional self-defense if he reasonably believed his life was in danger and his only recourse was to employ deadly force.

Thus, if Zimmerman verbally provoked Martin, but Martin then got on top of Zimmerman and banged his head into the ground, broke his nose, bloodied his eyes and persisted in attacking Zimmerman — and if Zimmerman couldn’t protect himself from further attack except by shooting Martin — he would have the right to do that. (The prosecution has already admitted that it has no evidence that Zimmerman started the actual fight.)

Holder's Justice Dept. will see to it that Zimmerman does time.

A lot will depend upon the timing of things. When Zimmerman is cleared of the state charges (assuming that he is), Obama could be out of office, in which case Holder would be as well.

The prosecution’s only chance now is if there is no jury.

I feel so sorry for Zimmerman [regardless of his being one of his own enemies]. He’ll have to leave the country to have any safety. I hope justice comes to every member of the media, every politician who had anything to do with blowing this thing up for political or ratings gains. Likewise for greedy parents who seek monetary gain and 15 minutes of fame.

I think he should consider going into permanent attack mode. He's going to be hunted (like Salman Rushdie) for the rest of is life anyway, might as well stand up and fight the bastards.

He's already shown he's no wimp.

What I meant is that it’s too late to drop the charges because of politically correct considerations, not legal ones.

I've read that Zimmerman is a democrat, I'm betting that come November, he will have a change of parties.

The case is really falling apart when you have Alan Dershowitz saying the charges should be dropped.

That Dershowitz is taking this position isn't really news. He has been sympathetic to Zimmerman's defense ever since the incident became a big national story.

What is a bit surprising is that the New York Daily News, whose editorial page generally leans to the left, is giving Dershowitz a place to speak out as he has.

But it's an opinion piece only. It would be more of a surprise if it were a Daily News editorial, which its title, on first glance, might suggest.

It’s too late to drop the charges. The let’s-grab-a- big-screen TV for Trayvon mobs are primed.

Let's see them try and do an "L.A. Uprising" Part 2 and get mowed down by a well-armed Florida populace. This 'aint L.A.

I hope the kids act sensibly after the verdict is announced.

Thank you for your general agreement.I'd be more concerned with how the adult criminals (and that's what rioters are) will act. This could be defused by the rabble rousers Al Sharptongue and Jesse Hijackson but don't expect much peacemaking out of them.

Funny how the Trayvon story has mostly dried up in the media, now that Zimmerman’s injuries have come to light.

But the black-on-white attacks have continued unabated.

Could be but there's a good chance he will remain a Democrap. Dems don't choose their affiliation based on facts or common sense.
