Steven Yorke and his partner Sara Proud went to Leicester Royal Infirmary on Sunday night when Proud realized she was in labor... they were told to wait in a side room with other expectant parents...80 minutes later, baby Kyle was born while Yorke was trying to find help. When two midwives did come to assist, the umbilical cord was wrapped around the baby's neck.

Kyle was quickly delivered and rushed off in the hope of being revived, but those attempts were unsuccessful.

There is absolutely no need for TWO midwives to assist an emergency birth. Sounds to me as if this was a scenario we see ALMOST just as often in the US - half-educated personnel running around at cross-purposes while the asses in triage polish their fingernails and fill out forms for illegal aliens.


When this scenario meets SOCIALIZED medicine in Europe, the half-educated are also underpaid and hung-over, the cross-purposes become multilingual and trans-generationally inefficient anyway, the bitches in triage have ten times the forms, and the illegals are Moslems.

The family is now waiting for autopsy results that will reveal whether Kyle could have been saved with better care.

I would want an independent autopsy, because I wouldn't trust it being done by anyone in the NHS.

The question comes down to whether the child died in the womb before coming to the hospital, was alive but at risk which could have been detected by listening for his heartbeat, or was born but then strangled by the cord. The first would have been sad but not the hospital's fault, the second could have been prevented by just about any 20th century medicine and the last could have been prevented by any medical care since the beginning of history.

Big government and unfortunately big business share the abuse of power which seems to come with size.

My daughter, working for the golden arches, went into premature labor but they refused to let her leave. They have a policy, if you leave without getting someone to fill your shift you are immediately fired. Not something someone expecting a baby wants to have happen.

Finally the pain got so bad, she left and drove herself to the hospital where she delivered but the baby was too undeveloped to survive.

Not surprisingly, there has been no lawyer, with a pair big enough, who wants to tackle the big M.

I am very sorry for the loss of your grandchild. Did the manager actually tell your daughter that she could not leave on that day, or did your daughter try to comply with the policy for fear of losing her job? Is it the local franchise or the company as a whole that you want to sue? The bigger problem may be that an unborn child is unvalued in money terms and that the lawyers think that it would be impossible to prove labor could have been halted if she had gone to the hospital earlier.

Big companies like McDonalds are lawsuit averse; they’re not hard to sue - witness the woman who spilled hot coffee on herself when she held the cup between her thighs.

If an employee is having a heart attack, McDonalds will not fire them immediately for calling 911 and leaving - to not exempt medical emergencies is a total invitation to all sorts of liability suits.

The manager actually refused to let her leave unless my daughter could contact a replacement. So the manager was forcing her to stay in this instance. It would seem that the manager, who had access to employee phone numbers and the authority to request someone come to work would be the one contacting people.

Yes, other than the people at the hospital telling my daughter they could have attempted to halt the labor there is no proof that a positive outcome would have been achieved. However, the same could be said for most medical procedures as “professionals” never guarantee their work.

IMO, common human sense, not legal niceties, McDs is responsible for preventing access to needed emergency treatment. She was bleeding and had severe cramping. Not a good sign when one is pregnant.

I would have thought a lawyer would be salivating over such a case but it was in Georgia so who knows. Now she is back in NY recovering from the emotional loss and financial loss thanks to good ole mom & dad.
