Here’s how it gets enforced: I sue my employer if he tries to implement any part of the act. I sue anyone who goes along with any provision of the act, when that acts to my detriment. You think lawyers won’t jump all over this hot legal cottage industry? They may vote democrat but ideology is trumped by their wallets.
The Courts have to award damages because the employer, or any private or government entity, cannot implement something not authorized by law. 0bamacare dies the death of 1000 cuts in the American courtroom.
I have heard some commentator with a legal background (Andrew Napolitano, Hugh Hewitt, don’t recall exactly who) say that SCOTUS has done that before, created severability where none in the law existed.
What’s the over-under on that?

I’ll take that chance and fight that fight. The damage done by this legislation is the obliteration of all individual liberty. If it gets overturned, then we have a fight. If not, then we have a losing battle.
Perhaps you've noticed who the Republicans are running against him? They've already failed, in my opinion.

Not only severability (which was taken out on purpose by Pelosi); but, the mandate is the funding. Without the mandate, how are they going to fund this monstrosity?
Scalia also mentioned the eight amendment when it was suggested the court could decide which parts could stay or go. IOW, it will be an all or nothing.
The entire thing should be struck down. It’s not about healthcare except putting older people to death and the other things in it are horrible and they can add to it without our knowledge. It is a cancer.
