I think this might serve as basis for a counter-suit.
The Obama administration said Monday it is suspending existing agreements with Arizona police over enforcement of federal immigration laws, and said it has issued a directive telling federal authorities to decline many of the calls reporting illegal immigrants that the Homeland Security Department may get from Arizona police.
There will be an increased number of calls from Arizona police, checking on immigration status-- and Obama refuses to budge the number of personnel handling such calls. In most cases, they simply won't even return the call (or pick up the phone).
That means police statewide can immediately begin calling to check immigration status — but federal officials are likely to reject most of those calls.
Federal officials said they’ll still perform the checks as required by law but will respond only when someone has a felony conviction on his or her record. Absent that, ICE will tell the local police to release the person.
Now what will the feckless Stupid Court do when the federal government refuses to obey the law? Suck their thumbs?

A good first step might be to park a patrol car in front of every social service office in the state. Step two, if the Feds refuse to answer calls from Arizona then let the folks in question rot in tent cities until the Feds start doing their job, start responding to the calls and these folks documents can be verified.
Easy answer, if no response from the Feds in 24hrs send the scum to Sheriff Joe. Let them rot in tent city until we get an Administration that will enforce the law.
Where to release them should be the at the discretion of the police. There is plenty of open space in Arizona where releases can be made, much of it Federal range lands. No water or shade, but lots of space. No proof of status and no answer from ICE about their status? Deliver them to Federal "property". Around 12:00 noon each day. All this summer long. With a hearty "Congratulations, you're released" and a nod from the bus driver toward the direction south. They're on federal land so let the Feds take care of them.
Bus them to DC and release them at 1600 Pennsylvania Avenue.

The President and his entire administration is violating their sworn promise to uphold the laws of the United States. They have stated so publicly several times. What more does congress need to impeach?
If the president or any other federal offical has the power to REFUSE to enforce federal laws duly passed by congress and signed by previous U.S. Presidents - then what is the point of having laws to begin with?? Can’t he just refuse to observe any law he wants now? He has lied to the American people in his taking of the “oath” of office.
The feds won’t do anything.
Congress won’t do anything.
It’s now up to the several States to take action. Are they still sovereign or not?
Arizona, and every other state that can show that they are harmed by the refusal of the Obama administration to enforce existing immigration law, should file a “writ of mandamus” in federal court to force the administration to enforce all of the existing immigration laws passed by Congress.

There are two aspects at work here: the legal side and the political side. We may very well lose in future legal cases (especially in the 9th circuit, etc.), but keeping the issue open helps politically (see the recent Ras poll out today on SB1070).
Also, I can't speak for Kennedy or Roberts obviously, but if a president made me look like a buffoon by announcing he wasn't going to enforce the law just hours after my opinion was released... I would be itching to have another bite at that apple...

Arizona Sheriff Joe Arpaio tells Newsmax.TV that Monday’s unanimous Supreme Court decision upholding a key provision of his state’s tough immigration law won’t change day-to-day enforcement efforts, but he called the Obama administration’s plan to ignore calls from Grand Canyon State police “arrogant.”
Published reports quoting unnamed Obama administration officials indicate that the federal government is suspending agreements with Arizona police over the enforcement of federal immigration laws, and that the Homeland Security Department has been told to decline many of the calls it receives from Arizona police over illegal immigrants.
“I don’t like to use the word arrogant, but it looks like they’re somewhat arrogant,” snapped the Maricopa County sheriff in an exclusive interview on Monday. “They took me to court last month — federal court, after a three-and-a-half year investigation stating that we systemically racial profile.”
