The Obsolescent Supreme Court

Justice John Roberts has made the Supreme Court superfluous and obsolescent by obsequiously abdicating its powers to the taxing authority of the U.S.Congress. Freeper Graewoulf has commented that Chief Justice Roberts has "destroyed the boundary between the Judiciary and Legislative branches of our government." My thoughts precisely as I heard the verdict come down today. But it is far worse than that.

This new taxing authority will do more than just restructure our economic freedoms and control behaviors. It can fundamentally change the concept of our Constitutional rights. Not only are we becoming Greece; we are becoming Egypt. The new president of Egypt, Muhammed Morsi, says Christians should "convert, pay tribute, or leave."

Justice Roberts has hastened the day when one will have to pay a fine/tax to be a Baptist, Methodist, or Catholic. Just like health care has become a 'right' provided you pay for it, so will the right to practice your religion, own a gun, or speak freely.

I can imagine not one choice, preference, or right that is not now under the taxing powers of the U.S, Congress. The rights remain only to the extent you can pay for them.

What is the point of a third branch of government now? All has been surrendered to the Congress. The only favor Justice Roberts has given is to remind us to trust no one. No longer will a Supreme Court protect us from the ravages of congressional usurpation of powers. It is up to no one but us.

Yes, our side has been energized, but at what cost? It is more than a horrific judicial precedent. It has made the Supreme Court obsolescent.

We better start coming up with a plan B that doesn't include the Republican party as the vehicle for change.

The point I was making is why have a Supreme Court when our Constitution has been rent and tattered?

What happened today reminds me of when, after Neville Chamberlain returned from the Munich Conference and had “deeded over the Sudetenland to Hitler, in reply, Winston Churchill told the Commons, “England has been offered a choice between war and shame. She has chosen shame, and will get war.”

John Roberts, in an effort to preserve the honor of the Supreme Court, has totally trashed it, and the court is without honor. The 9th and 10th Amendments to the Constitution are effectively removed, cancelled, because they are routinely ignored, and the Supreme Court is unwilling to call on those provisions to reign in the Leviathan that is our Federal Government.

Many more things can now be done with this new found “taxing power” that the 5 Justices were ready to embrace. For better health, a mandate to eat more veggies, or face a tax. We can repair the “Stolen Valor Act” by permitting people to lie about having unearned military honors, but we could impose an income tax surcharge on people who make false claims.

Now - the only restorative that I see would be if John Roberts laid a trap ....since the legislation started in the Senate, it is un-Constitutional on the grounds that ALL bills involving taxes must originate in the HOUSE. So....if some smart lawyers decide to file a new challenge to ObamaCare, and it gets tossed out on this new challenge, I will agree that Roberts played effective “chess” while the other Justices were playing checkers.

Now that the Constitution has been reduced to a historical curiosity the Supreme Court is useless. Why do we need these pretentious nuts in long robes?

Remember that Justice Roberts court is the same court that says its okay to lie because lying is a form of speech and as such it is protected by the Second Amendment.

This Court ruled that anyone can claim any kind of service, rank, and awards for valor irregardless of their actual service, rank, and combat performance.

So, why should today's ruling, in which. IMHO, Justice Roberts broke his sworn duty to try the facts be a surprise?
His finding essentially rewrote the case that the government argued before the Supreme Court. The government said it wasn't a tax but Robert's says it is. If that isn't rewriting case law after the fact I don't know what is.

Perhaps the next Conservative President will Roosevelt the Supreme Court; perhaps that might remind them that their oaths of office aren't to be ignored.
