FORT HOOD - Lieutenant General Donald Campbell Jr., the Commander of Fort Hood said Wednesday accused gunman Major Nidal Hasan still has his rank and is still drawing a paycheck from the military while he awaits court martial set for March 5, 2012.

Hasan's confinement and medical expenses are also being paid by the military, and he is moved on post once or twice a week for treatment and occasionally to see his legal defense team.

I don't mean to mislead by posting article from last year, but I wonder if this is still true. (His trial was delayed until August 20th, 2012) Did search and didn't see this previously posted.

I also wanted to mention how the media is silent about this, but yet has called for the execution of Staff Sgt. Robert Bales in the Afghan shooting and has also advocated gun control for the recent tragedy.

This Radical Islamist is still receiving benefits and payroll out of OUR pockets?!

I agree with you, yet until Hasan is Courts-Martialed and punishment comes back reducing/striping of rank and ordering the forfeiture of pay and allowances, Hasan, by regulation/law is still entitled to them.

True. Never really thought about that, but I guess the real question should be why our legal system does not provide a speedy trial. Things are just so backwards.

Unfortunately, until he is convicted, Hassan will collect his full military pay...per Uniform Code of Military Justice

When he is convicted, he loses all that...he will be immediately busted to Private E1, and lose all his veterans benefits. Also, he will have to pay fines, and, I believe he will have to pay for some of the costs of confinement

real question should be why our legal system does not provide a speedy trial.

The military courts, just like the civilian courts, do have a guaranty to a speedy trial. However, this can be waived by the defendant only, usually after consulting with his/her attorney. This is sometimes done as a delaying tactic by the defense. But I have seen where the defense does not waive this right, and it causes the prosecutor to 'put up or shut up' because they've got to drop everything to get their case together. In the military, it's 90 days from when the charges are read to the defendant until the court is convened.
