In wake of tragedy, lawyers step in: Colorado shooting survivor plans suit, says publicist

Torrence Brown Jr., one of the Aurora movie shooting survivors, is planning on suing the theater, confirmed his family's publicist on Wednesday. "We're going to make sure whoever is accountable is going to take responsibility for this tragedy," Cassandra Williams of Wet PR said. She said that Brown, who was friends with 18-year-old AJ Boik, one of the shooting victims, is handling the criticism his suit has sparked. "We know it goes with the territory, so he's fine," Williams said. She added that Brown, 18, is seeking therapy and is emotionally distraught after the shooting.

I agree but they had better be sure they can win before they fight that battle. We need a rock solid victory on this front. Losing would set a bad precedent for our cause.

I would sue the theater and the town for not permitting CCW.

Legally speaking, this lawyer will probably focus on the lack of security. As a public venue, theaters are responsible for keeping a safe environment (making sure that people don’t trip over things, access to fire exits, building maint., etc).

Exactly. Not sure why this doesn’t happen more often.

If individuals or groups are prohibited as policy from their right of self defense, then that responsibility, and liability, naturally falls upon whomever made that call, simple as that. “In loco parentis”, iirc. It’s plain as day.

Who do you sue and on what grounds?

Although I don't know what angle they'd use, the one that would get the liberal/socialist/democrats panties in a big wad would be if they sued because "The theater wouldn't let us protect ourselves (no gun zone) therefore the theater should have guaranteed our safety by whatever means necessary."

One of the people in the theater said that someone (maybe the killer?) got up and left the theater through the door 20 minutes or so before the killer came in. Hard to blame that on the theater.

No it isn't.

The coming lawsuits will blame all sorts of things on the theatre, but all of them will definitely mention the door ~ that witness is going to be very popular.

The witness, as I recall, didn't put a time limit on anything. He simply said the guy on the end of the front row (next to him) got up to answer a cellphone call (or so it seemed) and went out that back exit door.

Then the next thing he saw there was a guy dressed up and tossing grenades.

Yes, it's the door ~ Holmes had his car parked right there at the back presumably to make it easy to get his gear and guns.

There are door latch designs that cannot be defeated without sounding an alarm.

I used to tell people that a few good lawyers around were a good thing. I can’t hardly say that anymore. Far too many of them and so many scumbags. Our saying goes around here in TX, That it is just 98% of the lawyers that give all the rest of them a bad name........................

? This is hardly precedental. Back in the 1960s the entire building code in the United States (UBC and BOCA) was changed to require the use of exterior door locking mechanisms that could not be defeated by a simple chain.

That occurred after the explosion at the Indianapolis Coliseum that killed several dozen people when natural gas from a cannister used on a popcorn maker was released and then exploded under the stadium seats.

The problem in Aurora, and probably a whole huge bunch of theater exit doors is that there is NO ALARM system to report a door propped open. I"m pretty sure none of them can be defeatd with a simple chain, but this one may have been defeated with a small rock or a piece of tape!

When it first happened, several Freepers brought up the issue that Holmes propped open the exit door and no alarm sounded.

I don’t know if Holmes found a way to defeat the alarm, if the alarm was not working, or if the door just didn’t have an alarm period.

In any of those three instances, the theater could be found at fault.

They’re in deep doodoo.

In every multiplex theater I've ever been to, those side exits are not "Emergency Exits," with alarms. They are just exits, that patrons can use to leave the theater without going back out through the lobby. Obviously, they cannot be opended from outside, but they are made to be used in the regular course of business.

I know this through observation, and not because we used to sneak friends in through them at some time in a misspent youth.

In you theater, is there perhaps an alarm on a timer so that before the movie and while the movie is playing, the door cannot be opened without an alarm sounding? Then when the movie is over, the alarm is off?

I guess this will all come to light.

If the theater operated under normal industry wide standards regarding the exit door, then they probably can’t be found at fault on these grounds.

But if it is found that it did not implement industry wide standards regarding exit doors or that the exit door mechanism was not maintained, lawyers will crucify them.

Wait a minute there QT PIE; you called that statement /sarc, I call it 100% accurate. Just wait about 6 or 8 months then you will probably see ten different docudramas and at least a movie about it. Some people are going to try to get rich off of other peoples misery, always happens.
