GOP prepares to file lawsuit against Holder

House Republicans will file a civil suit against Attorney General Eric Holder during the August recess, House Oversight Committee Chairman Darrell Issa (R-CA) has told NBC News.

House Republicans will file suit in an effort to compel Holder to release documents associated with the failed "Fast and Furious" gun-walking operation.

"We'll be filing a civil case during the break," Issa told NBC, "We will expect a day in court before a federal judge, which we have a 100 percent chance that the judge will hold that these documents should be delivered."

During negotiations between House Republicans and Holder in June, the White House invoked executive privilege on the documents Issa had requested for his investigation. Issa says that a federal judge should find that executive privilege does not apply to the documents he is requesting.

Its ridiculous when you think Congress must use the courts to settle this.

Congress, the body we people elected to represent us, should be the authority that strips this guy to the bone. They should not be dependent upon the courts to get things done to an unelected bureacrat.

Only because we have a lawless administration is the reason for having to do this.

Goal for the GOP should be to make Holder’s and any allies lives as miserable as possible through the election. This way they cannot focus their energies on stealing the election for Obama.

You are so right. When corruption is being investigated the wheels turn super slow but when the majority are trying to shove something down the peoples throat that same system can move at lightning speed, such as the obamacare bill.

And it took corruption and arm twisting to make obamacare a slight majority. I think something like 70% of the American people want it repealed, too.

Interesting. I don't think there is any judge that can say a subpoena from Congress can be legally ignored. They would be disbarred.

I disagree. The Framers got it right when they limited the judicial sort of Congressional proceedings to the impeachment power. Aside from that, all judicial power under the Constitution resides with Scotus and other federal courts created by Congress.

Extra judicial actions by Congress (beyond impeachment) smacks of attainder, i.e. legislative punishment, which is prohibited by the Constitution.

If the Republicans hold the House and take the Senate in November, then look for the House to Impeach Holder and schedule a trial in the Senate in February '13. Then Holder will resign even if the new President doesn't fire him earlier. How would the line, "Impeached for Curruption" look on Holder's resume? What a disgrace to the office and to the country. Can't wait.
