WASHINGTON The Pentagon's top lawyer has informed the former Navy SEAL who authored a forthcoming book describing details of the raid that killed Usama bin Laden that he violated agreements to not divulge military secrets and that as a result the Pentagon is considering taking legal action against him.
The general counsel of the Defense Department, Jeh Johnson, wrote in a letter transmitted to the author on Thursday that he had signed two nondisclosure agreements with the Navy in 2007 that obliged him to "never divulge" classified information. Johnson said that after reviewing a copy of the book, "No Easy Day," the Pentagon concluded that the author is in "material breach and violation" of the agreements.
Johnson said the department is considering pursuing against him "all remedies legally available to us."

Just what does “material breach and violation of the agreement” mean?
He did not state the SEAL revealed classified information.
Part of the NDA requires review of any material prior to publishing. If he did not submit for review, it would be a material breach, wouldn’t it?
So, he may have breached the agreement but not revealed classified data. Not condoning such conduct (an agreement is an agreement) but would be a technicality and probably not pursued beyond some headlines and threats.
All he need argue is that when the Commander in Chief publicly released the details, factually correct or otherwise, the classified nature was thereby removed. And he felt it his moral duty to correct the details untruly proffered.
Would that not be the honorable thing to do?
No. If you are a civilian you can argue all the legal technicalities you want.
If you are a member of the US Military you do your duty, keep your commitments and honor the agreements you have signed.
Any action they take will only increase book sales.
I don't know what the *&%$ a "Jeh" is, but his comments on Don't Ask/Don't Tell make him sound as if he had a very, you know, personal interest in the outcome. And the picture of him didn't help.
Their primary agreement is to defend the Constitution against all enemies foreign and domestic. Any honest person can plainly see, and also know by his own words and actions, that Obama is an obvious threat to our Constitution and our Nation. This goes way beyond politics. I am amazed that military patriots haven't come to terms with this fact, and dealt with it as necessary.

The military has been apolitical for nearly 250 years. Should that change and the military becomes politically divided like the country as a whole then it and the country are gone.
I understand the inclination to want the military to be political but history has shown once that happens a nation is doomed..
Normally, I would agree with you. However, until the CIC becomes an honorable man and not only stops leaking our secrets for gratutuitous pleasure, and starts going after others in his regime that do the same, I say they need to back off the guy for wanting to set the record straight and to throw some water on the Leftists. Hope he makes a couple $million to boot.
