I have this argument in my bar all the time. I content that riding a horse home drunk is NOT a DWI (Driving while intoxicated). I grew up with horses and they know the way home, a good horse will simply walk/trot home if you just let it. So I content that I am merely a passenger, the horse is “driving” and the horse is not drunk. All my customers disagree with me, but in a sane world I would be correct. Please note that my argument is applicable only if you are just going home and not commanding the horse to do anything.

I think here in Texas you can get a DWI if you are on a horse, drunk and on a public road. I think you can get one on a bicycle too. But the state will have to find a jury to convict you. I doubt a jury would be inclined to convict someone on horseback or a bike just for being drunk. Now if they were causing problems, being a general pain in the butt, yeah, but just for being over .070? I like to believe a Texas jury would not do that.
