Bx. pizza boy 'raped' woman after delivering pie

A baby-faced pizza-delivery boy savagely raped a woman in her Upper West Side apartment yesterday while her young daughter slept next to her in bed, police and the victim said.

“I want him put away. I want the world to know he raped me while my 7-year-old was asleep next to me,” the distraught woman said tearfully during an interview in her apartment. “He violated us, it’s disgusting — roaming around apartments looking to hurt people while you’re working.”

Suspect Cesar Lucas, 16, of The Bronx, allegedly prowled the 35-year-old victim’s West 61st Street building after delivering a pie to another person on her floor at about 12:30 a.m., police said.

If he is guilty he should be shot in the face.

Never happen, thanks to the U.S. Supreme Court which ruled that it is unConstitutional to sentence a juvenile to life imprisonment, or for that matter,a number of years designed to keep him/her imprisoned until they die.

The best thing for lawabiding people to do now is adopt a mental attitude that I must protect myself and life because no one else is going to. While it is true that at one point in time long ago that the law and police were on the side of the law abiding individual, that no longer is the case.

Actually a business could be a corporation which could go bankrupt..In this case the kid’s liability extends to the father who OWNS the business. Better go after the father since you get both his personal assets and his business = dual bankruptcy...

Cops arrested Lucas after finding him at work at New York Sal’s Pizza on Tenth Avenue between 48th and 49th streets — which is owned by his father, authorities said.

No they did NOT.

SCOTUS ruled that in the case of a juvenile criminal the lower courts were not FORCED to issue the minimum punishment or life in prison guidelines mandated by state/federal laws. They still have the option to keep the little punks behind bars for life.

The requirement is youth must be taken into consideration and that individualized sentences are handed down...ie it give the judge/jury latitude in determining whether or not the life sentence without parole is warranted. The offender does not receive the sentence because it is mandated but rather because it is warranted.

After re-reading my post, I am going to clarify, the courts CANNOT give mandated life sentences to minors, but must give individual sentences. The courts CAN give individual life sentences where warranted.

If the headline writer puts "raped" in quotes, does that make it a legitimate rape?

It's VERY poorly written, but what I think the headline writer was trying to do was quote the woman who claims she was raped. A quote, not "square quotes."

I also find it extremely odd that someone in the same bed could sleep through a savage rape.

We don't know the facts. Maybe he gagged her, or more likely she controlled herself as to not wake the child, to protect the child, trying to remain as still and quiet as possible. She likely wanted her child to remain asleep and as unnoticed as possible, so as not to draw the attention of the brutal rapist to the child, and also to spare the child the horrible memory of her mother being terribly raped. Maybe she is a very smart and sacrificial mother.

If they had a dog, he likely wouldn't have picked her apartment. Dogs can be wonderful at keeping the riffraff away.

The kid’s 16, won’t even get to trial until he’s 17, will be released when he turns 18. If I was in charge, the kid wouldn't reach 17.

Although I do not practice in NY, the normal procedure elsewhere is to obscure the identity of a juvenile defendant by referring to him as "C.L." instead of giving his full name and all of this identifying information about his father, etc. So, since we are privy to this, either the police have been extremely sloppy or the decision to try him as an adult has been made. I'd say it is the latter and this guy won't be seeing anything but Sing-Sing, until he is about twice 18.

The quotes are the same thing as saying "accused" or "alleged". It's CYA against defense attorneys that use the argument that a report saying that a suspect actually did the crime taints the jury pool, and violates the "innocent until proven guilty" protection of the Constitution. It's also protection against lawsuits in case the suspect is acquitted or never actually charged.
