Beloit family suing school over spilled soup

An attorney for an 8-year-old Beloit Turner student has filed a lawsuit in Rock County Court against the school district and its insurers over hot soup they say injured the student.

According to the suit filed by attorney Derrick Grubb, Beloit, the student was served hot soup by cafeteria staff during lunch Nov. 29, 2011, at Powers Elementary School.

The suit states: The hot soup was placed on the girl's lunch tray. She began to carry her tray to another table, but someone bumped her, and the tray tipped, causing the hot soup to spill onto her left forearm and cause injuries.

The suit alleges the Beloit Turner School District and its employees were "negligent in serving a substance at an unsafe temperature to an 8-year-old child, were negligent in failing to properly instruct its students on how to carry the unsafe substance, failing to properly warn its students of the unsafe substance and the dangers thereof, and failing to properly supervise its employees, agents and students at all times material to this complaint."

The district and its employees "were a substantial factor" in causing the burns to the girl, and "she suffered and will suffer personal and bodily injuries, pain, humiliation, embarrassment, worry, permanent disability, health care expenses and other economic losses," according to the suit.

I guess it never dawned on the shyster “lawyers” to sue the “someone” who bumped her and caused the tray to tip. The taxpayers have “deeper pocketes” I guess.

How stupid.

Our society has become an entitlement-minded, whining juvenile who must be “warned” of every conceivable danger, and even inconceivable dangers. All these idiot lawsuits do is cause ridiculous over-regulation and drive up costs of operating business. It is impossible to make the world “safe” by endless danger warnings.

OK kids, this soup is extreeeeeeemely dangerous, so put on your asbestos suits and carry the hermetically sealed soup thermos with both hands. You'll have to do this with the buddy system so one of you can carry and the other can be the spotter.

Since the burn occurred nearly a year ago, I would have expected to see a picture of a horribly scarred arm in the story. Any bets on whether you can even see anything from the burn from which "she suffered and will suffer personal and bodily injuries, pain, humiliation, embarrassment, worry, permanent disability, health care expenses and other economic losses,"?

Maybe soup shouldn't be on the menu. I went through school eating hot lunches, and I can't remember a single time soup was served.

I have to add, that I was responsible for burning 2 of my own children in separate accidents with hot soup. I had a set of soup bowls with steeply angled sides. Little children would reach across the table to pull the bowl towards them and the bowl would tip and cause the soup to flow over the child's hand and shirt sleeve. The bowls went into the garbage the second time that it happened.

Interestingly the child who was wearing a polyester, long sleeved shirt was not injured. The soup just beaded up and rolled right off. The child who was wearing the same style COTTON long sleeved shirt still bears a scar because the fabric soaked up the soup and held it right onto his little wrist, resulting in a nasty burn. It broke my heart a second time when he was in school and proudly told me that he always knew left from right because "my left arm has the scar." Dagger in my heart!

Oh Good Lord!

The “lunch lady” (are we still allowed to use that term these days?) once poured a whole ladle full of tomato soup over my hand accidentally. She quickly took me back to the sinks, ran some cold water over it for a minute or two, made sure I was okay and let the lunchroom monitor know to tell my teacher what happened. Then she gave me another bowl (and grilled cheese too!) yum!! I was absolutely fine!

Dear Gawd, if I had to count the number of times I got burned from overly hot foods from school lunches it would take a week....

New Rules and Regs for all public school: Schools will now be required to serve only cold potato soup and only with pureed potatos to avoid choking and only in one teaspoon servings to avoid weight gain and with a straw. Spoons can poke an eye out. Recipe will have no salt and only use non fat milk for the base. Only one student and their personally assigned EMT will be allowed to use the cafeteria to eat. The only decoration in the cafeteria will be a 12x8 foot sculpture of Michelle Obama for inspiration. Student will have one hour to eat and one hour to be alone with sculpture to contemplate.
