Supreme Court justices cast doubt on Texas program that looks at race in college admissions

Supreme Court justices sharply questioned the University of Texas’ use of race in college admissions Wednesday in a case that could lead to new limits on affirmative action.

The court heard arguments in a challenge to the program from a white Texan who contends she was discriminated against when the university did not offer her a spot in 2008.

The court’s conservatives cast doubt on the program that uses race as one among many factors in admitting about a quarter of the university’s incoming freshmen. The liberal justices appeared more supportive of the effort.

Justice Anthony Kennedy, whose vote could be decisive, looked skeptically on Texas’ defense of the program. “What you’re saying is what counts is race above all,” Kennedy said. He has never voted in favor of an affirmative action program but has voiced support for diversity in education.

Twenty-two-year-old Abigail Fisher, the rejected student who sued, was among the hundreds of spectators at the arguments. Also in attendance was retired Justice Sandra Day O’Connor, who wrote the majority opinion in a 2003 case that upheld the use of race in college admissions.

The only thing getting old is good for is an excuse for step farting and saying whatever you want to say, regardless of which in-laws are in the house.

Which isn't a bad trade off, now that I think on it. ;)

Among the liberal justices who looked more favorably on the Texas admissions system was Justice Sonia Sotomayor. She told Bert Rein, Fisher’s Washington-based lawyer, that he was looking to “gut” the nine-year-old decision.

Once again, the wise Latina proves she isn't fit to be seated on the SC.

Our largely accidental, and mostly unwanted policy of unending mass immigration is what created the demographic nightmare. Things like affirmative action/racial preferences are an inevitable result of mass immigration-driven demographic turmoil, not a cause.

It’s a disgrace that the now massive collision between affirmative action and immigration policy gets almost no attention at all. That the media ignores it is a shame, but hardly surprising. That the GOP ignores it is also not surprising considering their cowardice on both issues, but it is infuriating nonetheless. Over 30% of the population is eligible for some sort of racial preference, and if current demographic trends continue, then it will be over half the nation by 2050. This is insane! And if Congress or the Courts won’t end it, then it will never end, as groups that benefit are not going to just willingly give up preferences.

Preferences should be abolished, but what really needs to happen is a drastic reduction in immigration. Like libertarians suffering from the delusion that the welfare state can be ended while mass immigration continues, it is similarly crazy to think racial preferences are going anywhere so long as we continue to import millions of future beneficiaries.

You're starting with a false premise. Afirmative Action was never a sole qualifier for admission to a given university. It was always "one of many" determinants, but one that held greater weight than academic achievement, etc.

The problem we have is one of perception. In many states (including Texas from which this challenge emanates) whites are now statiscally minorities. However, the perception remains that whites are the dominant race that still discriminate againt minorities. Despite the fact that there is no data to support the perception, liberals cannot allow whites to benefit from programs that were created to benefit the "minorities".

For these reasons, I believe that CJ "John the Backstabber" Roberts will side with the liberals on the Supreme Court to ensure that Affirmative Action is with us for generations to come. Remember, liberals always live in the past and the past is where all of the preceived injury occurred. Therefore, we must control the present and the future from the past.

The mass immigration is caused by the low birthrate, which is caused by the fact that people don’t feel secure enough to raise families (affirmative action being one of many factors that come into play there).

Without mass immigration you would have dead cities, empty schools, etc. I don’t want the immigration (at least the illegal immigration), but that’s why they are here.

I’ve been in a state school with minorities that could barely read; it was the ONLY reason they were there. Connecticut had a firemen’s lieutenants exam thrown out because not enough blacks acored high enough - it was plainly worded as such.

It is still the sole qualifier in many areas.

As Ann Coulter famously said: why are latinos getting “civil rights?”

America’s Civil Rights laws are intended to redress Black Americans’ grievances over years of harshness.

What did we ever do to immigrants? They broke our laws coming over the border from the Third World.

What “grievances” do these latino lawbreakers have that they demand be redressed under US civil rights laws?
