CLEVELAND, Ohio — The RTA bus driver and young woman passenger whose bare-knuckled battle went viral in an online video both face charges, Beachwood’s prosecutor says.
Shidea Lane, 25, brought an assault charge Thursday against Artis Hughes, 59, of East Cleveland, said Prosecutor Tom Greve.
Hughes’ epic uppercut leveled Lane on Sept. 18 aboard an RTA bus in Beachwood.
Her lawyer, Dale Friedland, said Hughes provoked his client and verbally abused her.
“No man should ever treat a woman that way,” Friedland said Thursday.
The Greater Cleveland Regional Transit Authority brought a charge of disorderly conduct against Lane, 25, of Cleveland, Greve said.
Several witnesses said Lane hit Hughes while he was at the wheel. Hughes and one witness told police that Lane spit in Hughes’ face.
RTA pressed the complaint against Lane “for her actions” during the fracas, according to an RTA news release. “Misconduct on public transportation is a crime,” spokeswoman Mary Shaffer said.
Greve said the cases will be handled in Shaker Heights Municipal Court.
“I’ve had an opportunity to review the overall investigation by RTA [police],” Greve said. “The video of the incident will speak for itself on the charges.”
RTA suspended Hughes without pay while the agency investigates the incident. It was captured on video by several passengers and has been viewed by millions.
Lane and Hughes initially argued over whether she had bus fare, which she was able to pay.
The argument grew loud and Lane increasingly profane before she appeared to approach Hughes, who was seated at the wheel.
He stopped the bus and faced off with Lane before delivering the blow.
The disorderly conduct charge against Lane is a fourth-degree misdemeanor that carries a maximum $250 fine and 30 days in jail. It’s the only charge RTA has the authority to bring, Shaffer said.
The assault charge against Hughes is a first-degree misdemeanor carrying a maximum $1,000 fine and six months in jail.
After the incident, Hughes signed a form with Beachwood police refusing to press charges against Lane. Neither he nor Lane could be reached for comment.
Hughes’ punch was not a crime, said William Nix, head of the union representing hundreds of RTA bus and train operators.
“She got in his face and spit on him,” Nix said. “He has a right to defend himself.”
