Virginia AG on Patrick Moran: ‘No Indication That Any Offense Took Place’

Virginia Attorney General Ken Cuccinelli says “there’s no indication that any offense took place” when Patrick Moran, the son of Rep. Jim Moran (D-Va.), discussed voter fraud with an undercover reporter on Oct. 8. Moran resigned as his father’s campaign field director Wednesday, after the video – produced by the Project Veritas activist group – was published online. The video shows the congressman's son engaging a discussion – which he did not initiate -- about forging utility bills, which can be used as voter identification at the polls in Virginia. They'd "have to look legit," Patrick tells

I have to agree.

Talking about robbing a bank is not a crime.

The crime occurs when you actually rob one.

Harken back to Criminal Law class, I believe thatthe crime of conspiracy to commit a crime does not require the subject crime to be committed—only a step towards the crime. Is counseling someone who indictaes intention to commit a crime how to do it “a step” towards the crime?

Cuccinelli is pretty solid...I would have to give him the benefit of the doubt that it is not worth pursuing

Just guessing here, but I suspect that the argument against a conspiracy charge would be that, because the one participant was performing a kind of sting, and not actually planning to commit the crime, it can’t be a conspiracy.

If the terror suspect plants a bomb he thinks will blow up but instead is a trick-bomb that won’t cause its a FBI sting. The perp never committed a crime since nothing blew up.

Doubtful that it applies in this case. Talking about a crime and PLANNING a crime are two entirely different things.

If merely talking about committing a crime were an arrestable, prosecutable offence, then it could happen anytime somebody said something as simple as “I’m going to kill you!” in the heat of anger - regardless of whether they actually intended to try to do so or not.

Conspiracy involves more than merely talking, there has to be an element of intention to put talk into action.

Excuse me? He described in excellent detail how to commit voter fraud. He is in a position of authority. Anybody with common sense could see this warrants an investigation. The AG has the right to bring this to an election committee and a judge for opening a case and getting a subpoena and getting documents, bank records and phone records. This is why we are losing. We have to see who is involved and expose the cockroaches to sunlight. The only reason we are talking about this at all is because a neophyte journalist got the story.

The AG and our Gov are a waste. Glory boys filling their pockets. If you “talk” about harming the president, your done. If you “talk” about your stocks, Martha Stewart, your are done. The key is Moran is either filling pockets or the repubs are so afraid of Kaine they are unwilling to stand up for what is right.

I also agree, talking about it not the same as doing. What it does is show he’s dishonest and has no respect for the law or for the rights of the citizenry that their vote will count as much as anyone’s. The democrat, liberal, progressives have been engaged in a revolution in this country since the 30s. The current administration and democrats for the last 50 + years has been engaged in econoic terrorism against this country in an attempt to cause financial disaster and the destruction of our government. Stealing votes is an end to their means, anything to stay in power.

Without an actual overt action to commit fraud, all Moran has to say was that he was humoring the guy and that he was going to file a police report, but the story broke before he could do so.

It’s total BS, of course, but it’s reasonable doubt.

We regularly discuss how crimes could be committed all the time ~ right here in 'river' FreeRepublic!

None of us have an intent to commit such crimes of course ~ right guys????

Latest discussion was about the guy in Montana who could have set up an ambush with his girlfriend to nail her husband ~ or some other scenario. There are a number of possibilities ~ but the local law enforcement folks seem to be too busy to take a good hard look ~ and so there we are, talking about possible crime, and possible government corruption.

The Moran kid, though, wasn't just describing how a crime can be committed ~ he was his father's campaign manager, a position of trust, and he was talking about how to currupt the election process.

Now that's pret'near a crime, but not completely.

That's why the Arlington County prosecutor is going to initiate an investigation. The Virginia state attorney general is probably not going to be involved unless the Arlington prosecutor comes up with some evidence that Moran cheated before ~ of which I have no doubt. Him, his old man, his mother,....... the whole crowd of creeps from Boston. They cheat when they tell you the time.

Yeah, in a manner of speaking you are right. Patrick has had to resign from is worthless father’s campaign, but the whole sorted mess is out for all the voters to see, so maybe it will adversely affect the election. We can only hope it does!

You gotta' understand there are plenty of liberals in Moran's district who are probably conspiring to kill him even as we write notes back and forth.

The GBLTs tried to beat him in the primary a couple of terms back ~ they failed!

Moran is one of those outrageous folks who mortifies everyone he comes into contact with.
