Nov. 13, 2012, Fairfax, VA—Americans for Limited Government President Bill Wilson today urged Governor Rick Snyder not to implement a state-run health insurance exchange under Obamacare.
In his letter, Wilson wrote that the governor “hold[s] the fate of President Obama’s Affordable Care Act, also known as Obamacare, in your hands,” noting that if the exchange is not implemented by Snyder, employers in the state will be protected from the law’s employer mandate.
“Without the cost burdens imposed by the state exchange, your employers will enjoy a significant competitive advantage over their competitors in states which have exchanges,” Wilson wrote.
The letter references a study by the Cato Institute’s Jonathan Adler and Michael Cannon, “Taxation without representation: The illegal IRS rule to expand tax credits under the PPACA.”
In it, Adler and Cannon make the case that “An Internal Revenue Service (IRS) rule purports to extend these tax credits and subsidies to the purchase of health insurance in federal exchanges created in states without exchanges of their own. This rule lacks statutory authority.”
The study explains, “The text, structure, and history of the Act show that tax credits and subsidies are not available in federally run exchanges. The IRS rule is contrary to congressional intent and cannot be justified on other legal grounds.”
By not implementing the exchange, the state would effectively give affected employers the standing to sue against the new IRS rule, Wilson said in a statement.
“It is up to Governor Snyder to at least give employers a chance of fighting against Obamacare. But if the exchange is implemented by the state, they will not have any chance at all,” Wilson concluded.

He’s a glutton for punishment from the left. He keeps reaching across the aisle and keeps getting his hand bitten. Its a wonder he has any fingers at all.
If he caves on this he is no better than Granholm.
He’s not very bright apparently.
He promised to work to keep right to work off the ballot if the unions would keep proposition 2 off the ballot. Prop 2 was on the ballot (fortunately crushed) and he ran out to announce that he still believes in collective bargaining.
I’m not saying he hasn’t done any good for Michigan, he’s signed some good legislation sent to his desk. As another FReeper calls him, Rick (I’ll take it from here) Snyder.
Fortunately we have an elected attorney general and he is fighting against Obamacare
The only bright spot in the entire election for me was the stomping Prop 2 took. It was a giant f/u to the unions and about the only thing that kept me from going off the deep end. I would LOVE to see Michigan become a Right to Work state. Unfortunately, I don’t think he has the balls to pursue it.
We need to get it on the ballot without him and I would even bring the union conservatives to help because they do support right to work.
Problem is, how many conservative union members are going to publically speak out against the unions? That’s a very dangerous game to play.

My husband started a new job in the summer, first time we’ve ever been in a union in our lives, and it’s private sector. Can’t speak to anyone else that he doesn’t directly work with but of the ones he does, they were all very vocal regarding their disdain for Obama. Shocked me. I think if Right to Work were implemented, you would see an abundance of people opt out of the unions.
I doubt it would kill the unions outright but I do think they would shrink dramatically and would be forced to be better labor representatives and force the union execs to behave better.
Guys like Trumpka and Hoffa would be removed by the members themselves. In fact I believe the union was accused of fraud by its own members in Hoffa’s reelection.
Rick Michigan. First time ever I didn’t vote Republican at the top of the ticket.
We’ll see, I’m not holding my breath, he wanted to implement it before the election.
I voted for him but I didn’t like it.
