Wait, if a President can subvert the Constitution by way of an Executive Order what makes you think he won't do it again to fund BATF?

And if you think that SCOTUS will come to the rescue I got two words for you: "Justice Roberts"

I would reply back then, "What obligation does any law officer, employee or even citizen then have to follow such a leader?"

I My answer: None. Zilch, Xero, Nada, Nitcht.

Moreso, anyone who follows a clearly anti-Constitutional law, directive, edict, or order are THEMSELVES equally guilty.
