A county magistrate in North Carolina ordered Tuesday that a Mexican man deported two years ago receive custody of his three U.S.-born children.

In an unprecedented decision, Alleghany County Judge Michael Duncan ruled that Felipe Montes, 32, be provisionally reunited with his sons Isaias, 5, Adrian, 3, and Angel, 2.

"The court cannot find that the father is unfit," Duncan said. "The permanent plan is reunification with the father."

Montes was deported in December 2010 after receiving a series of traffic fines and immigration authorities found he was in the country illegally.

So now all felons have a right to custody of their kids?

That should go over well at the penitentiary.

I’m not complaining. What I see here is a clever judge who figured out a politically correct way to deport three anchor babies.

It sounds like the right answer. The mother has already lost custody. She is evidently a mess. If the father is fit, as the judge has ruled, then it makes sense for him to come get them and take them home. It would not make sense for them to go into foster care when they have a father who wants them.

He’s been granted a “special” visa. Wanna bet it turns out to be an extra special one that allows him to stay in the US with his poor widdle children?

The choice was the dad or the state. I choose the dad.

I will not take that bet because you are correct

Dad just got himself Illegal Alien Amnesty from this judge.

Which means, the state (in this case, North Carolina) will end up supporting the 3 kids and their dad, in various ways
