The top U.S. military appellate court on Monday ruled that the judge presiding over the case of an Army major charged with a 2009 massacre at Fort Hood, Texas is not impartial and ordered him removed. The court also set aside the order by the judge, Colonel Gregory Gross, that accused gunman Major Nidal Hasan be forcibly shaved. The action by the United States Court of Appeals for the Armed Forces further delays the trial of Hasan, 42 (snip)

What is wrong with this judge? Did he not hear Joint Chiefs Chairman Dempsey when he said he wanted to make sure that the Armed Forces did not lose diversity ?

The Pentagon is going to get this murdering terrorist off. They don’t want to have to answer for “workplace violence” or as an honest person would say, Islamoterrorism occuring on the largest military base in what was once the free world.

I'm trying to figure out why this turn of events makes me think back to the recent purging of flag officers...

I don’t think he’ll get off. But he’ll get treated with kid gloves. He will never go to an ordinary military prison. Probably spend the rest of his life in a Club Fed somewhere.

This judge just ordered that the damn beard be shaved off.

About time too, I was getting a bit tired hearing about it. But, now we start over, and I guess the terrorist keeps his stupid beard. Yes, that is sarcasm.

Can anybody explain why we have never seen one family member on tv of a person, a member of our military forces, killed by Hassan?

The media loves to highlight sad stories, but the stories of Fort Hood are cast into eternal darkness. That this happen is more crimes!

This crap is blowing my mind. As a retired military veteran, I sat on several courts-martial trials. I can assure you that if this was Sergeant Joe Blow on trial for murder and he refused to shave as per regulation, his sorry ass would be clean shaven every damn day, willingly or unwillingly.

Being of sufficient age, I am reminded of the almost endless delays engendered by the North Vietnamese concerning the shape of the table at the Paris Peace Talks. Absolutely nothing to do with the actual issue, just a method of tantrum and control.

Same here, the need to determine guilt is a nonissue, instead we get this Kabuki Theater of the Absurd. Do I think that this Administration had no desire for a trial during the election ... Of course they did! This is just a continuing operation to keep this “Workplace Violence” out of sight and mind.

This massacre took place on November 5, 2009, over three years ago. The murders took place in front of dozens of witnesses. Even the Mayberry police department could have investigated this crime, sat a jury, presented the evidence, and concluded this trial with a guilty verdict in less than a year. I am ashamed of what my military has denigrated into, a politically correct farce led by an illegitimate amateur.

If I’m correct, doesn’t he maintain his pay as a major until he’s convicted? If so, isn’t he still subject to UCMJ? If so, slam him with article 15’s every time they can for violating military grooming stands. It’s a small thing, but drip him of half his pay and demote him every time they do it

You’re absolutely correct. I don’t know his physical capabilities because of his paralysis, but I’m sure he is bathed and fed, he can also be shaved. And if he goes to the courtroom, he is dressed in his military dress uniform. Standard operating procedure.

He does have the right to not elect to receive the Article 15 and ask for a trial in lieu of the Article 15 for each offense.

I'm just waiting for the complaining from the Republican Party when that happen.

The gutless wonders have given Obama a really free hand at doing whatever he wishes so far.So they really have nothing to complain about.

The UCMJ as written is rather clear. The problem is that a defendant is entitled to representation by a civilian lawyer if he wants one, and this a--hole can afford better lawyers than the Army has to prosecute. In general, the military routinely gets its ass kicked in court for this reason.

Yes, with full pay and allowances, and yes, he's still bound by the UCMJ. The Article 15 process won't happen because he's been elevated to "protected class". Hell, the authorities wont even classify him as a terrorist combatant but an outlier perp of workplace violence.

All true. It was also pointed out by someone else on this thread, he could demand a court martial instead of an article 15. I had forgotten about that part of article 15’s. It would just drag it out longer if he went that route.

The murders took place in front of dozens of witnesses.

In a location where military troops were on duty and not allowed to have weapons!

And they were murdered by a person who was tasked with examining the mental condition of troops returning from Iraq/Afghanistan. That little piece of information makes me angrier about these murders than anything else.

He should have been gone as quickly as Saddam Hussein was dispatched.
