Police: Man Shot Dead By Officers Pulled Air Pistol That Looked Like Gun

NEW YORK (CBSNewYork) -A man with a record of 39 arrests was shot and killed by police detectives in Queens overnight, after pulling what police thought was a gun, but turned out to be a compressed air pistol.

Police on Sunday afternoon continued to investigate the shooting that left the 42-year-old man dead. The suspect killed by police had not been identified as of 3 p.m., pending family notification.

Around 10:45 p.m. Saturday at Gates and Seneca avenues in the Ridgewood section of Queens, two male plainclothes NYPD detectives – ages 48 and 42 and both nine-year department veterans – had just had arrested a 33-year-old suspect in a buy-and-bust drug sting operation.

At that point, they were confronted by the suspect, who pulled what looked like a Glock 19 semi-automatic handgun, police said. It was actually a Walther CP99 compressed air pistol, but was designed to look like a Glock, police said.

The drug dealer who was arrested initially said the suspect with the air pistol “appeared out of nowhere,” and watched as the man pulled the weapon at detectives.

When he did so, the dealer said he told the man with the gun, “They’re cops, you idiot!”

When the Colorado shooter burst into the theater, most people thought he was waving a toy gun and it was a stunt.

I am in charge of an historic site, and some satanist freak brought a very realistic “toy” gun on the site because he wanted his satanist girlfriend(s) to make a video of him pointing it at a religious symbol. I made him leave the site, but other visitors (including somebody in law enforcement) told me that they thought it was a real gun and that I should have called the police.

It may have been a real gun, I don’t know. But in any case, if somebody is going to go around doing this in public places, they’ve got to take the consequences. And it is absolutely true that an air pistol can kill you.

now you know.

If you'd pulled your piece and cut the guy to ribbons, you'd never get out of prison though. cops can do this without penalty.

OTOH - someone could have a real gun, paint some orange on the muzzle and people would then think it’s fake. Trick someone out until it’s too late.

Exactly. Even fake guns in Australia you need a permit. I’ve seen pellet guns at gun shows that shoot upwards of 1,000 fps in .22 cal.

I’ve spent thousands of hours at on the mean streets of a hundred cities in the wee hours of the morning and not been shot. people less wary get shot every day.

I'm one of the first to jump on the cops in most of these shootings... but this one seems justified. The only hiccup that I see is that the arrestee had enough time to say “They’re cops, you idiot!”, and yet it still escalated. But if the idiot was warned, AND proceeded against the police with an air pistol, then you may as well call it suicide-by-cop.

I'm not crazy about the never-ending parade of police shootings (my father served for 22 years in the 5-boroughs area, and never once shot anyone - despite being fired upon 3 times), but I can't see this as anything but justified.
