Does Congress Have the Authority to Tax Americans At Different Rates?

The 16th Amendment gave the Federal Government the authority and power to tax every citizen. Here’s the wording of the Amendment:

“The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.”

Please note that there is no provision in this amendment that Congress is given the right to unequally apply this power. In looking over all the Constitution’s amendments, I don’t see an unequal distribution of either a freedom or limitation.

Equality under the law requires that as each of us stands before the courts or the Constitution, no one should be treated in an unequal way. The law applies to every citizen equally, except, it seems, when it comes to apply the 16th Amendment.

equality under the law would mean women and miorities weren’t special legally protected classes of people either. nobody does’anything about this.

For those individuals over whom the fedguv exercises jurisdiction, the income tax is applied uniformly. Are you under the personal jurisdiction of the fedguv?

I think it simply means that two people with exactly the same circumstances would pay the same rates.

You can't have someone with $100K net taxable wages and salary income in Texas assessed at 40%, while someone in Illinois is only assessed 10% on the same $100K.

Who the hell do you think you are? How dare you question our rulers, and since when does Anything in the Us Constitution have to do with Congress and their wishes?? Speaking of which, where is this supposed document I hear people wine and bitch about?? Does it even exist? or is this another one of those fantasy dreams where you believe you have certain unalienable rights that are self evident and absolute and cannot be infringed upon? Do you really believe that?? Prepare for induction to your local re-education facility, cuz with thoughts like that you will become a Target to our Rulers. Liberalism 101:

I'm for higher taxes for “the rich,” defined as those that make more than me.

I'm for abortion, but sure am glad I'm here.

I'm for banning anything, such as ATV’s, guns, cross country biking, hunting, skiing, owning “attack dogs,” scuba diving, big cars, for speed limits, against sugar, fat, soft drinks in schools, homeschooling, helmet-less motorbiking, smoking, Christian symbols in public places... as long as you don't ban what “I” like to do!

I'm against the death penalty, but it would be rude and inconsiderate to ask me what I would want done to someone that murdered my wife after they had raped her.

I'm for legalizing drugs, but don't want my son taking them.

I think prostitution should be legalized, but don't want my daughter being one.

I support socialized health care and the rationing of care, but if I bump my head I want that MRI.

I think people should adjust their thermostat to 68F in the winter and 78 in the summer to save the planet, but I'll live in a 20,000 square foot mansion heated and cooled to 71 all year around- in fact I'll fly around the world in my private jet to tell you how you need to cut back!

Get the drift here?

In a liberals mind there is no principal other than some egalitarian and pure hedonism. Words like fairness, diversity, open minded, and these eco scams are their lingo and causes. They are not concerned in the truth, i.e. consistency, nor creating wealth. Equality, security and maximizing their own pleasure in this short term is all that matters.

The original AlQaida plan was to take out both the White House and the Congress with simultaneous airplane attacks. They had backups to their plan with an apparent attempt to assassinate George Bush in Florida, and most likely with an Anthrax attack on the federal bureaucracy and CapitolHill complexes and offices.

No doubt there were numerous other things they had in mind but did you ever hear of what they wanted to do to the Supreme Court?

Are the actors who were going to do the court still in place ready to strike at a moment's notice?

We are not going to be doing a NOH theater performance that starts with a ghost and ends up with a single judge ~ but there will be something and its unlikely the USSC will be reconstituted any time soon after that.

Yeah, but Obama can't waive income taxes for residents of Illinois or double the income taxes for Texans, the way he's waiving Obamacare for friendlies.

Asking whether such-and-such is constitutional is pretty meaningless given that our federal government hasn’t played by those rules for a century or more depending on who you ask.

Exactly. If this guy gets this excited about the 16th amendment, someone should show him Article I, section 8--It'll blow his mind! (Though the ruling council has considered virtually everything "regulating interstate commerce", for a very long time)

I’m don’t claim to know anything about constitutional law, but it is very evident that congress, with the support of the US Supreme Court, is free to ignore the US Constitution. The Robert’s court has made that abundantly clear. We are living in a time of utter lawlessness.

In my never to be humble opinion, everyone should pay the same AMOUNT. Why should I, or anyone else pay more to run the government than any other citizen does. That is patently unfair. The cost of the government should be borne equally by all citizens equally.
