Lawsuit Filed Against Journal News Sparked By Map of Gun Owners

A lawsuit has been filed against The Journal News by a business that claims its reputation suffered after the newspaper published an interactive map of licensed gun owners in the area, following the massacre in Newtown, Conn. First Impression LLC is a gift shop and interior design firm located in Katonah. They sued both The Journal News and its corporate parent Gannett Co. in Westchester County Court. In the Summons with Notice, the gift shop accuses the newspaper of “falsely…publicly stating in the interactive website www.lohud.com that plaintiff First Impression LLC is a licensed handgun owner.” They are represented by McDermott and McDermott of Somers, N.Y. and claim to have lost business since the publishing of their company’s name on the map.

I noticed from the summary that they didn’t sue because they have a pistol permit, but rather, they were listed as having one when they don’t.

I want a lawsuit from someone who was listed because they *do* have a pistol permit.

I hope the the lawsuits keep coming.

I e-mailed an advertiser and told them that they advertised through a paper that was making my “non-permitted” relatives in the area SITTING DUCKS.

I'm no lawyer, but I imagine there would be no grounds for a lawsuit by a licensed gun owner in this case. If gun licenses are a matter of public record and a newspaper publishes that public record, then gun owners would have a hard time pursuing any legal case.

In this case, however, the fact that the newspaper apparently published false information -- and the business can demonstrate that they have suffered a financial loss as a result -- puts the newspaper in legal jeopardy.

What about a permit holder falsely left off the list? Now the owner lives in fear of being mischaracterized as an easy target.

They can publish gun owners names but they cant publish Obamas college records or his imternational travel as a young man or even the birth certificate that rebuts the forgery that has been publicly circulated or who ordered the Benghazi stand down that got 4 American killed.

F the Media, IMO its only a matter of time until somone takes them out.

Per day they can prove they lost business. When they can’t pay up, ask for ownership of the paper. Fire all the libs and hire actual journalists. Watch sales go thru the roof.

I personally know of retired law enforcement officers who’s names were disclosed on the interactive map.

I’m no attorney either, but do have some experience in the data sales business. There is a huge difference in one record (does John Doe have a permit for a gun) when used to answer a specific question. Compare that to pulling all the records, with a very different goal.

I believe that everyone in the community has a potential cause of action against the newspaper for almost anything that now happens in the community:
- Any burglary of a home that was on the list can claim that they were targeted
- Any home burglary of a person not on the list can claim they were set up as an easy target
- Businesses that lose sales because of boycotts, can make a claim that they were targeted for a legal act (having a permit for a gun).
And so on...
The newspaper’s actions were not based on writing a story (if it were, the specific names and addresses would not be necessary), rather compiling the public data and creating a new data set (the full list) for the purpose of shaming people.

I hope that everyone on the map (and a lot of those off the map) sue the paper out of existence.
