I am aware that these kids probably did assault this girl. That however, is not going to be easy to prove. This type of assault is always difficult to prove.
Like I said. The cross examination will be brutal for all involved. The defendants do not have to take the stand. The witnesses and the victim most certainly will have to take the stand. I sure as hell wouldn't want to be the victim when they start in on the questioning.
Meanwhile there is no physical evidence and the pictures are not incriminating, At least the one on the website showing the boys carrying the girl. She looks to be out cold, but is she? Is she just playing around with the guys. If she is out cold, are they abusing her, or helping her onto a couch so she could sleep it off?
You are assuming that deleted files are really gone. We'll see.
I expect that the prosecutor will make Twitter, Facebook, MySpace, and possibly cell phone companeis cough up records. I bet there is a lot of elelctronic evidence still to be found out.
Also, there may be physical evidence. A shower doesn't get rid of abrasions and bruises. Or torn spincter muscles. It doesn't get rid of sperm in the vagina or anus.
I suspect there are lots of people who saw lots of things and have no interest in helping the "Rape Crew" get over. When you drag a unconscious girl across town you are going to get a lot of evidence. Possibly even some non-intoxicated people who want to testify. Adults, too.
A lot of people are going to be put under oath and asked to answer questions. I suspect many of them, who did nothing wrong, will be told by their parents and lawyers to do as the law requires and tell "the truth, the whole truth and nothing but the truth". I suspect when a lot of people do that there will be a lot of evidence. Perhaps even evidence "beyond a reasonable doubt".
But, maybe not. That's what trials are for, after all. We're at the very beginning.
